Help. Accepted offer, but HSBC now won't pay!

Hi
Can anyone help me as I am unsure what to do next.
I commenced court proceedings on 21st May, and then on 9th June received an offer for 80% of my claim. I took a day to think about it, decided to accept, and signed and posted my acceptance form. However when the 14 days HSBC said it would take to credit my account were up I checked my account and found nothing had been credited. When I phoned the bank to ask what was going on they confirmed they had received the acceptance form, but said I had commenced court procedings after the offer, and there was nothing they could do as my case was now in the hands of their solicitors. Tried phoning their solicitors but just got a recorded message suggesting I contact the court as they were unable to deal with my query.
What should I do now? I don't really want to go to court.

I would say it's HSBC's loss as now they will have to stump up 100% especially since you can prove to the judge that you were actually prepared to settle for 80% but HSBC then decided to play dirty. Don't give up now, everyone who files a claim must be prepared to go to court, but many people don't even get that far!
I would write a letter to HSBC pointing out that their offer, which you accpeted at the time, was sent AFTER the court claim and as such they had no right to pull out of it, but that as they have, you feel justified in now continuing your claim for the full amount + interest + court costs, and that they have to settle the full amount if they don't want to waste the court's valuable time any further. That letter will make a lovely addition to your court bundle.Reclaimed thanks to this site:
