Double Entry ANPR, PCN issued after 14 days, Civil Enforcement Ltd,

Hi everyone,

Have been reading the forum since I got an PCN from Civil Enforcement back in February. They claim I was parked for 3 hours, but I actually visited the car park (linked to a Holiday Inn hotel) twice as I dropped my wife off for a meeting then picked her up later. I first entered at 5:30, left 5:32. Entered again at 8:20, then last exit at 8:30. That's the 3 hours they claim from 5:30 to 8:30. The PCN was issued by ANPR, nothing left of the car as I wasn't there!

The initial PCN arrived after 14 days from the incident date and I have read that it should void the charge as I was the driver? Is this correct?

From the info in the sticky I have appealed on the basis of the 2 point above but to date have heard nothing of the appeal except a PCN reminder that the charge is unpaid.

Just feel a little worried today, and I know that is what CE what so I pay up. It would be good to get feedback from you people here.

    if this is in england or wales then the RK can be held responsible under POFA 2012 , although obviously the driver can be named to exempt the RK

    so no it doesnt void the charge

    what you seem to have there is known as "double dipping" , where they class 2 stays as one continuous one

    info on parking pranksters blogs tell you all about anpr and double dipping, something he regularly checks with highview

    Thanks for your reply. I am the RK and was the driver on that day. It did happen in Eng/Wales

    They can, but it means they follow pre-PoFA 2012 Section 4 rules and can only go after the driver. And they won't know the driver unless you tell them!

    I've not told them who was the driver, only appealed to them as registered keeper. I think I read it here not to tell them who was driver.

    they have up to 6 years to chase the driver under the small claims court (if they knew who it was, which they dont)

    the 14 days refers to POFA 2012 liability which I also explained earlier, this is what can make the RK liable, the driver is always liable, especially if the drivers details are revealed

    you are mixing up their right to issue an invoice and get paid within 6 years - with pofa 2012 , 2 separate issues

    in any case, the first instance was less than 5 minutes so doesnt count , neither does the double dip count, which is why anpr is classed as unreliable, as you would see if you read parking pranksters blogs like I mentioned earlier

    reply again and say cancel the ticket or issue a popla code like the BPA CoP and BPA newsletter insist , otherwise you will report them to the BPA and the DVLA due to a breach of their rules (not cancelling or issuing a popla code within the time frame after an appeal is lodged)

    Yes, all very well, but you appealed and got no reply so why not also follow the advice to complain to the BPA by email about this and write to CEL to demand your POPLA code? If you have now read the NEWBIES thread, you should know you should have got a reply to your appeal, and you'll know how to win at POPLA too I hope?

    You should get an acknowledgement within 14 days and a result within 35.

    To cover the situation where the parking company pretends to lose your letter, email the bpa after 15 days and 36 days, stating you have not received a reply to your appeal, which is a breach of the code of conduct.
