POPL PCN advice

We have been harrassed by a third party who is acting on behalf of P4 Parking London. Allegedly one of our drivers received a 'PCN' on 19/11/13, which he appears to have disregarded. P4Parking did nothing further and handed it over to the 3P co, who wrote to the company we hire the vehicle from with an 'unpaid parking enforcement notice'. They wrote dated 18 March and it was received on 26 March. The hirer immediately gave them our information. We have now received a 'Final Demand for Payment'. At no stage has a 'NTO' been issued to the hirer or us, and we have no way of disputing the PCN or viewing any evidence of it. Your website has been very useful and given me lots of legal information, which I think demonstrates that P4Parking has not followed the code of practice, and neither has the 3P. Has anyone got any further advice on this sort of matter? Thanks.

As you are a company you need to provide the name and address of the driver, sending the letter as shown in the NEWBIES thread in the section about 'you think your are too late to appeal?'. You need to discharge your potential liability, pronto, so they bother the driver instead. Send it by email if possible so you have a record that P4Parking have received it & copy in the debt collectors as well for completeness. You may have to post that one but just use 1st class post (NOT recorded/sign for).
It would be daft to leave yourselves open to a small claim when you simply need to provide the name & address of the driver under the POFA 2012, to remove your company from the equation. If the original 'ticket' was a windscreen one then the driver won't get sent a PCN and is too late to appeal - but it becomes his case to ignore, not yours, and his case to defend if P4Parking decide to try a small claim.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
