Hi guys,
After my recent success of winning my appeal a friend approached me asking for help as his dad had done the same as me and stoped at the famous bus stop to drop off a passenger.
The contravention date was in February and they ignored it up until he was told about me winning my case for the same place. Now he was the driver but not the registered keeper of the vehicle. The last letter they got was a keeper liability letter as they ignored the first. They have not had a threat of court yet.
Would it be best to still appeal as the RK or reset the appeal by giving the drivers name and details?

If there's been no windscreen notice then the keeper can name the driver and reset the clock, so the PPC has to issue a Notice to Driver which can be appealed.0

As per the NEWBIES thread, if 'too late to appeal' that section explains that the keeper can indeed name the driver (name and address). However both VCS and Excel (owned by the same person) like to play silly devils and pretend that it is too late to name the driver. The keeper should do it ANYWAY because it is a fact that this will discharge their potential liability under POFA2012 and there is no longer any case against the keeper.
If the driver then gets a PCN in their name, all well and good and they can copy your success.
If the keeper or driver just gets silly letters pretending it's 'too late' for the driver to be issued with a PCN they can complain to the BPA Ltd and/or ignore and keep ALL the letters. Just in case VCS decide to try a small claim or two in the future. The keeper would not be liable and the driver would never have been sent a PCN so you can see that both would be in a great position to defend if they keep all the letters and can show that liability was transferred by VCS ignored it/didn;t issue the driver with any PCN.
The keeper must not use words like 'reset the clock' because clearly that's forum-speak and Excel /VCS don't like us lot much!
The driver should NOT write at all until they hear anything in their name.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi, I received a parking charge on my windscreen whilst parked in Morrgate Retail Park carpark stating I had left the site, however, I have a receipt from Home Bargains where I was shopping during the times stated on the parking chage! IS it just a case that I write a basic letter stating I did not leave the site and enclose a copy of my receipt to prove this? Many thanks in advance0
