  • Ok after recieving the info you stated, I would say there isn't much chance of hope on this one, sorry to be the barer of bad news. It's for this reason, someone who is taking a life assurance policy out (and correct me if I'm wrong it may be a different type of policy) who is 58 years old and a diabetic with other problems aswell would just simply not get life assurance. If medical conditions had of been disclosed they would have refused to insure him, I totally appreciate where you are coming from when you say he was honest etc etc, the only thing I can think of if it was done over the phone is that he may have got confused or answered what he thought was right. Again if you can obtain the recording this will make things alot clearer. For him even to get a policy in the first place at the age of 58 he would have to have more or less a totaly clean bill of health as he would be to much risk for the insurance company to bare, which means that his life insurance policy must have gone through with no medical declarations.

    Again push for the tape, but its very unlikely it will be a positive result but it still doesnt hurt to pursue it, if the policy was sold to him they may be at fault for not asking the relevant questions??

    If it was done over the phone, that suggests he approached them and not the other way round.

  • bit of an update

    his widow has already complained to the insurance through her mp

    the insurance are unable to offer a copy of the actual phone conversation as they no longer use the company which took their calls - they have sent a copy of the transcript of what should have been said. the insurance would not reply or give any info until the mp got involved, apparently 2 letters went unanswered

    it seems the diabetes is not the argument here - his medical notes state he had ischemic heart disease in 2002 - and this was the cause of death

    however, in 2002, he went to hosp with chest pains and all he was told was that he had not had a heart attack, - but i think it was written in his notes that he had this heart problem then maybe?

    - he had no further heart problems, angina medication etc - in fact i think it was the only thing that was not wrong with him/presenting symptoms

    apparently he was paying £15 per month and the payout is approx £25k

    anyway, widow is now going to ombudsman and has got her mp on side too so i guess we will just have to wait and see

    Not wanting to sound callous here but who is the actual beneficiary of the policy?
    If the answer is next of kin then she will get the money as well as the house under the intestacy laws that spouse will get first £125k.
    What I don't understand is how you get the money and how she will sell house to you for just £25k.

    I may have missed something in the postings - sorry If I have.

    basically she says she needs to sell the house to pay bills - we are desperate to keep the house for our daughter - we are hoping the life insurance money will be enough to pay the bills and then she will let us have the house - well here is hoping - alternatively we will have to try and pay the bills ourselves i guess

    we don't want the money - we want to preserve the house - that is our goal here

    Data protection does allow for client details to be supplied unless there is a complaint, in which case the company has no requirement to supply you any files.

    This is going to sound really cruel but from what I have read here the OP will not get a bean and it is wishful thinking that she is just going to 'give up the house'.

    This what happens when people do not make wills. I am just as guilty here because although my wife has made one I haven't.
    Next time I'm on holiday with a few days off I think I will!
  • Right if he was paying £15 a month that is on standard terms which means that no medical conditions were declared. Like I said before if he had of declared previous problems whether suffering at that particular time or not he would more than likely of not been able to get cover. That premium indicates nothing was declared. I think the insurance company is gonna be right on this one I'm sorry to say.

    Im in a similar situation here - my 82 year old father (who died at easter) had a policy with Stonebridge.He had been paying £9 a month,and had had the polcicy since about 2003 (I thihk! - cant remember right now) when he took the policy out,he was fit and healthy,apart from being on tablets for high blood pressure.

    When he died,because had died before the A&e doctor saw him,he needed a post mortem.The coroners findings were pulmonary Oedema and Ischaemic Heart Disease.

    These two things are all that is on teh DC - but he choked on a piece of meat,and collaped in our kitchen. When the paramedics came,they unblocked his throat to tube him - (the meat was bagged up and taken away by them) he was defibbed twice before they left.He didnt come round, hence the PM.

    He had a stroke in 2007, but had been signed off from all his aftercare - but also - we have been told that this should be irrelivent,There is no doubt that he died as a result of choking on meat,and as it obviously wasnt there when the coroner did the pm,of course it wouldnt get a mention - far as the coroiner was concerned,it was another old person who had died unexpectedly.

    Ive written to ask for medical history from dads GP,also the head of A&E, and the ambulance service (who I am assuming will keep records!) as when we contacted stonebridge to ask about appealing, they told us to collate as much info as possible that may help us.

    Is there anything else I should be doing at the moment??
