lost goods

I recently ordered an item on line. When I hadn't received it by the due delivery date I contacted the vendor who told me that the parcel had been delivered and signed for. I have checked with my neighbours, none of whom signed for a parcel on my behalf. The courier supplied a copy of the signature which was illegible and insisted the parcel was left with one of neighbours. The vendor will not refund my money or resend the goods because the courier has a signature. The courier insists it didn't deliver my goods to the wrong address. What can I do?

How did you pay for the items and what was their value?

Do you have it in writing it was delivered to a neighbour?

If so, go back to the retailer and remind them that you have a contract with them to delivery x item to your address, not your neighbours and that at present, they are in breach of that contract.

It is not up to you to chase the courier or your neighbours. Yes you've been reasonable in asking them, but its ultimately not your responsibility.

They are liable until possession passes to you - which by their own couriers admission, didnt happen. It is not for you to prove you didnt receive it, it is for them to prove that you did.
