HELP - what to do next

Hi

We bought a car for my son from a garage in Morden, Surrey 2nd Feb, cost of the vehicle was £3900, we paid for this using mastercard via a paypal card machine, stating this as not sure whether we would have any rights with either of these 2 companies. We got the car home and discovered numerous faults, car even though it had a valid MOT was definitely NOT roadworthy, some of the faults were:-

Horn didn't work
Handbrake light came on and wouldn't go off
No heating or air blowing out at all, so unable to clear windscreen
bodykit loose
front light wasn't held in place with anything and could have just come out
track rod end
steering wheel off centre, the list goes on....
anyway we went back to the garage and requested either a refund or all the issues fixed
they took the car back and promised to fix all the problems and put a years mot on it to prove its roadworthiness

its now 24/04 everytime we call we just get excuse after excuse, still waiting for parts etc

its been over two months now, anyone got any idea on how we can get this progressed and where we stand legally?

Also in the meantime we have paid insurance on this car for a 19 year old which wasn't cheap :(

    Horn didn't work - MOT fail, was it working on the test drive?
    Handbrake light came on and wouldn't go off - Sure the brake fluid is ok, could be a loose connection on the lever
    No heating or air blowing out at all, so unable to clear windscreen - Not an MOT requirement, did you not check this on the test drive? could just need a new thermostat or the heater matrix has been bypassed or lever broken for one of the heater flaps or the resistor is blown
    bodykit loose - Any sharp edges? Did you see this when you saw the car first?
    front light wasn't held in place with anything and could have just come out - Missing screw/bolt or is it broken?
    track rod end - What about it, missing, damaged or has play?
    steering wheel off centre - No an MOT fail or a fix that would cost anything

    Its taken 2 months for the garage to do nothing, have they fixed any of the faults?

  • Hey, not sure if they have fixed any of the faults as they still have the car, say it just needs springs that it took over two weeks for them to arrive, that it has gone elsewhere for the repairs, honestly we didn't test the horn or the heating, stupid I know, body kit has no sharp edges but is loose (you can get your hand behind it in places), we paid to have the thermostat replaced from a local mechanic as he thought that may be the issue, but still nothing, no air whatsoever coming from vents, the issue with the steering wheel (I think) is that it has been fitted incorrectly vxr wheel on a 1.2 corsa club, the track rod end not sure what is up with it but the local mechanic said it needed sorting out, which is when we then rang the garage up insisting for the refund or repairs
  • Also not sure re the front light it could be just a bolt that is needed there no idea, the light unit looks ok visibly from the front, just not secured with anything

    Send a letter before action stating they have failed to remedy the situation within reasonable time and without significant inconvenience and you hereby reject the car by virtue of the sales of goods act.
