My Balance is due for a BA family holiday to Dubai for this July and my elderly mother has taken ill ! ... I am very doubtful my holiday insurance will compensate me if I'm unable to go due to her age and pre-existing medical conditions ... Before l pay the balance i am wondering if l pay by CC would l be covered for refund under section 75 ?? Anyone any knowledge re this Much appreciated

Paying the balance doesn't affect your ability to claim, but s75 doesn't cover what you want regardless. It's a typical case for a travel insurance that s75 has nothing to do with, although some CCs used to offer it as an extra benefit.0

If your holiday insurance fails to pay out in this case, I think you will be wasting your time attempting any other avenue.
Talk to the holiday provider and see if they will waive the balance (or possibily a portion of it) as you are now unable to take the holiday.
If not, ask if it is possible to change the names on the holiday, again perhaps for a small charge, e.g. to allow you to sell the holiday to someone that could take it.

Did you declare your mum's pre-existing conditions to the travel insurance when you took out the policy?
Is the reason she is ill related to her pre-existing conditions?

S75 makes the card issuer jointly liable with the merchant. Unless you can prove your merchant made your mother ill then there is no S75 claim.
Your insurance is another question. Assuming your mother isnt travelling then only a tiny number of insurers allow you to declare non-travelling family members medical conditions. If you didnt buy from one of them/ didnt declare the conditions then you are right you wont be covered there either.
If she isnt travelling but the medical issue is unrelated to any pre-existing conditions and is just a factor of her age then your travel insurance should cover it.0
