Hi Everyone,

I'm new so please bear with me while I try and get used to everything. I have read the parking sticky thread but I'm still a bit confused as to my position.

So today I parked at a Sheffield uni library car park as I have done on many occasions. It is a category C permit car park and I have a category C permit on my car registered to me. When I returned to the car I had received a civil parking charge notice from Car Parking Partnership stating I had not paid and displayed demanding £100 (£60 if paid in 14days)

I looked into this when I returned home and found that in the permit conditions it does mention you need to pay and display however this is something I had failed to notice when I had received the permit.

There is a sign on the entrance to the car park which states it is category C parking but any writing to do with pay and display is very small and looking on BPA website does not meet their recommended criteria. Also the pay and display machine is in an obscure place. (I can't seem to post pictures as a new user either)

I would like to appeal this but I do not know where a stand for the below reasons:

1) The car is not registered to me: it is registered to a fleet belonging to my uncles company.

2) The university said unpaid fines can prevent me from graduating (this July.. :(

3) The charge will increase to £100 if i appeal.

4) My uncles fleet company could be charged.


Sorry if anythings been asked before, with the rules changing to do with private land parking charges and the university graduation aspect I wasn't sure.

    Write and appeal now as the driver, using the template letter in the NEWBIES thread. Change the wording to 'driver'.

    No worries about unpaid fines - this isn't a fine, you are entitled to appeal - and it will be cancelled on appeal at POPLA stage.

    CPP would be in breach of the Data Protection Act if they passed on any information about you to the University without your permission.

    Have you noticed that the University's "enforcement" page states that the alleged debt is with the University? Evidence of CPP's absence of locus standi.

    Thanks for the replies. I'll get one sent off today.

    As for my address, would it be better to use my uni address (moving out in June) or my home address?

    EDIT:

    Also, should I use their online appeal system or send a letter by post?

    Just for reference, I'd be careful here... for no other reason than that when I was at the same University, I had a similar parking permit, and on application for it with the uni it was made abundantly clear that a Cat C permit only entitled you to use the pay and display car parks, and that payment was still required.

    You've still got a decent shout so give it a whirl. If nothing else, worst-case you should only owe them for the lost revenue they would have gained had you paid for parking anyway. Just be a bit careful with the wording of the letter.

    Well he can use the template in the NEWBIES thread which gives nothing away and doesn't talk about the actual issue of what happened!

    Sheffield91 I would use your home address, partly to disassociate it from your student status a bit, also because presumably your parents can tell you when the reply arrives with the POPLA code (it's time bound and only valid for 28 days to then appeal to POPLA - so check every week re the post to your home addy).

  • Hey everyone,

    Update:

    Today I logged into the representations area on CPP website and found there was no record of my ticket. I called them up just to check the status and they confirmed that the ticket has now been cancelled and I will receive a letter in the post! :) £60 saved by reading this forum.

    Thank you for all your help on here and through your other threads. I will let you know what the letter says when it comes through.

    I have told all my friends who basically said "Pay it before it goes up to £100, you'll never win" and they're pretty shocked, some have a lot of regret for private parking invoices they have already paid.

    A lot of cars have been ticketed recently in that car park, if I see anyone with one I'll make sure they take a look at template on here.

    I use a pay & display ticket or use the car park out of hours now that I actually know their rules which is fair enough :)
