Newlyn Bailiffs: Not accepting My repayment

  • We aslso have dealings with this company I received a text message from newlyn today that said a van was coming at 1 pm today to remove goods from house I phoned the number to be tyold the council tax debt was in my partners name I phoned him at work he phoned them to sort things out only to be told its to late and we now have till Friday to pay £1000 he offered to set up a payment plan but was refused and told that she has the power to have him imprisoned she was not prepared to listen tyo reason we have never received any letters from them until today we had never heard of this company we knew we owed the money from when he was made redundant we really need to get this sorted need advice please

    If they've not previously been in the house that is going to be difficult as they have no right to force entry and you will not be inviting them in with such a rude attitude!

    They have no power of imprisonment, as they well know.

    Stop talking to them - they are idiots.

    Find out if this is correct by checking with the council.

    Work out what you can afford, put this in writing then start making the payments. There's good advice from National Debtline in this thread

    The bailiffs are talking a load of rubbish. They can bring a van but that doesnt mean they can break into your house ( unless you have let them in previously) and they can't imprison you. They also can't necessarily charge for the van unless they have followed set procedures ( which I'm pretty sure they haven't).
    Any more rubbish from them and I would ask for their bailiff number and report them for misrepresenting their powers. I'd report them to their firm, the local council (and then escalate to the local government ombudsman) as well as whoever regulates bailiffs. It's ridiculous!
    Find out from the council how much you owe, what property it was for, the time period(s), the date of the liability order and exactly what charges are included in their figures. I would also suggest something in writing from the bailiffs detailing exactly what you owe with a breakdown of charges so you can check them (given the way they have conducted themselves so far I dont trust them not to try and rip you off).

  • Re: Councillors asking difficult questions - many years ago I worked in Council Tax recovery (before the advent of private bailiff companies), and the one thing that would get things moving and having management running round like blue-ar*&! flies was to get a councillor involved. My advice is to always try and negotiate. Well done in avoiding filling in the statement of earnings - many councils would immediately go for an attachment of earnings order if they had that information. I'm not suggesting you lie, but as far as I know, the details that people put on those forms are rarely if ever checked, and there were cases of those who had been scrupulously honest about their circumstances being in effect penalised by having an immediate attachment of earnings order (and they will very rarely be cancelled), whereas those who knew how to play the system knew not to give out that information.

    If the bailiff cannot peacefully get in to your property you will be able to tell the them how much you can offer them. If they do not wish to accept your offer their only alternative would be to pass the debt back to the council. You would then be able to negotiate directly with the council.

    So, just to recap, so long as you don't let them in to your property you can tell them that you are prepared to offer them £X per month - and if they do not wish to accept it, they can pass the file back.

  • I have sent an email to my local councillor asking if he can help I also set up a standing order to make regular payments im now wondering if I should email newlyns to say that this is what ive done as they have refused any offer of payment plan
  • Just had a phone call from newlyns saying as we haven't paid £1000 today they are going ahead with the enforcement feeling really scared as I'm in house all by myself while he is at work
