Miss-sold a car

Me and my wife went to a car showroom 8 years ago looking for a car to buy on finance.at the time one of the staff said we couldn't get the finance because we had a black mark against our name.so we went home thinking ok we'll just have to try and save some money and try and pick a cheap one up somewhere.
The company rang us back 5days later then saying they could get us finance so we decided to go and see them that weekend .it was our first time buying a car and we were vulnerable.
As soon as we got there they had a car lined up for us which was £3500 and we went along with it .We felt very pressured and before we knew it we had signed the paperwork to buy this car.Before we went we spoke to another member of staff who recommended we keep the private plate on the car so no one would know the year so we (being vulnerable)agreed and as she handed the keys over said you will be able to tax the car at any post office.
When we got back I went to tax the car and we're told we can't tax the car because it's not registered in this country .I called the company who sold us the car only to be passed from pillar to post .this went on for over a week when I did finally get to speak to someone they told us it was nothing to do with them anymore,so after a couple of months we stopped the payments to which we received severel letters ,the last one we received saying "we owe £13000 "for a £3500 car.The bay lifts came shortly after and took the car (with some personal belongings in it)and we still had to pay the debt company the money in monthly instalments .is this acceptable ?because we feel we were treated very unfairly and tricked into buying something we couldn't use.is there something we can do to get some of the money we paid for the car,back.

    I'm sorry but its impossible to provide any decent answers to your over-arcing question with the details you have provided. For example you said 8 years? Doesn't seem right and the time period these things happen over can make a great difference.

    I'd advise either editing your op or replying with a clear bullet pointed timeline of dates and facts with exact amounts owed, infornarion exchanged and to whom. I.e. the garage, the finance company and the debt collectors. Put as much information as you can without emotional or irrelevant facts.

    I don't want to sound harsh or criticising but if you want clear succinct advise, we need a clear succinct picture of the facts and not a wall of rambling text that gives us no real information apart from your feelings.
    Back by no demand whatsoever.

    The finance company can repossess the car - but for bailiffs to come round and repossess other stud then a court order would be needed... This would require them to issue court proceedings.

    So sounds like you ignored letter before actions, then county court paperwork, then still failed to take proper advice which could have meant you apply for the judgement to be struck out and a new hearing date set and now your paying the price of inaction.

    Also seems like you never followed any kind of procedure in rejecting the vehicle - especially if it was repossessed later down the line. So what formal complaints was made to the dealer? What communication did you have with the finance company before seizing payments?

    You'd be better off getting proper legal advice on this in order to mitigate the situation if at all possible.

    Also the time line is crucial...but I suspect any action you may have had would now be statute barred

    As it was 8 years ago then no chance of reclaiming any money now.

    If you had sorted it with teh finance company and the dealer then you probably could have avoided the hassle.

    8 years later then way too late.

    So you were sold a imported unregistered car 8 years ago, kept it but stopped paying for it?


    Why didn't you take it back to the dealer? Did you ever register the car for UK use? Have you been using it?


    It seems quite reasonable to ask for you to pay for the item you kept.

    So a dealer, years ago, managed to get finance clearance on a wreck of a car that wasn't even UK registered. Next!


    Although I do like the idea of bay lifts.

    Can I ask why you've now decided to ask a question about it, some 8 years after the event? It just seems bizarre to wait so long.

    Maybe, maybe not.

    But since most threads originating by people who haven't yet been doomed by order of natural selection are deemed to be 'trolls', we wouldn't have a very vibrant or interesting forum if we stopped replying.
