Ticket overturned by POPLA

Hi,
this is my first post and I just wanted to tell you all that I got a parking ticket in the post from McDonald's, Gatwick airport back on 20th February. The driver of my car overstayed by 17 minutes and I got a ticket for £100 reduced to £50 for prompt payment.
I read your forum posts and followed the procedure, appealed to MET parking, they refused my appeal, like you said they would, then appealed to POPLA using your template letter. They submitted evidence to POPLA, very disparaging of my template letter and arguments contained. POPLA e-mailed me today saying my appeal is upheld because this was "not a genuine pre-estimate of loss", just like you said they would.
I just felt that £50 or £100 is not a fair penalty for a genuine oversight of 17 minutes overstay.
Wanted to say thank you to all those who provided info. and templates. Another victory for the little guys.

Thank you for two things :

2. Coming back and telling everyone. It cheers regulars and assists Newbies.

Well done cycleguy, proving that this can be done without handholding from the forum, but by using the well documented and well tested NEWBIES sticky's advices. :T
Just one thing from your post above:I just felt that £50 or £100 is not a fair penalty for a genuine oversight of 17 minutes overstay
Even a penny would be an unfair penalty as private parking companies have no legal right to issue 'penalties', even though they think they can! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Congratulations,
I won at POPLA for this car park only a month or so ago.

Well done to you for doing the leg work and getting a win !When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
