1st bad play trade sale

sold a game i got free from work on play trade. I listed it as brand new and unopened. which it was. they have emailed when it arrived to say they want a refund as its not sealed and not new.
Well i did not say it was sealed, just unopened.
Not sure where play trade stand on this? its as described and its defintaley brand new (game was launched the day i got it).
I have no ratings yet but don't want to refund if i don't have to.

Not sure where you would stand on this one, if it was me I would ask them to return it for a full refund - if it was not high value I would just refund.
I would have listed it as 'Brand new and unused, just not sealed' - just to be absolutely clear - 'unopened' to me does suggest sealed.
According to the distance selling rules, I think you have to accept a return and refund.
There is no facility on Play to respond to feedback, unlike Amazon and Ebay, so if you get a negative you cannot leave your side of the story.

I think the word un opened is the problem. Unopened is the word for sealed in the game retail business. You should have stated "Was not sealed, but never taken out of box" etc.~*Cerenia*~

It will have been copied by now, I don't sell DVD, games etc mainly because of this problem. Think you will have to decide on how to play it but i would tend to agree the "unopened" bit possibly implies sealed, think a refund on return and be more careful next time.0

most games i get new are not sealed, play itself even says new means unopened and brand new AND still in shrink wrapping if originally was - ie unopened is different to shrink wrapped. With Xbox360 games it has a seal along the side that would be broken if opened, my PS2 games do not have that.0 -
The buyer was probably expecting it to be sealed, as most new games are and if a game is not sealed it is very difficult to prove it is new and hasn't been copied or activiation key (if it has one) used. The customer may never have received a new game previously that was not sealed and as your description did not state this clearly is probably why they aren't happy.
As you state the game was free, you have only lost postage in event of a refund, so not to big a deal refunding to try and preserve your play feedback.
So far with Play I have sent out over 20 orders and have yet to receive a single feedback. I may have to actually buy something from play to see how the feedback process works so I can explain it to buyers who probably have had no experience of leaving feedback.
Also, even if I knew a game was new, but it was unsealed I would not grade it as new, I'd use the like new and mention it was new but unsealed to avoid this sort of thing happening.
If anyone has any guidance on how to leave feedback I can send to customers it would be appreciated.Do You Twitter?

yep, no feedback yet and 8 sales done, no idea how its done, could be like amazon and sent ages after the actual sale.
shall use like new for unsealed games from now on. but still, only refunding to keep score high (assuming anyone ever gives me feedback), no actual need to do it.0 -

I've never had an unsealed game from play.com, and from working in the games industry, about 75% of games are sent to retailers with manufactuers seals on, some admittedly arn't (Pro Evolution 6 was one for example). Microsoft issue a microsoft seal down the side on main microsoft games - not all of them, i've had fun processing delivery trying to detirmine if we've been sent new or preowned due to this. I know GAME online used to do plastic tags on thiers, which could not be taken off and put back on, that was also classed as unopened, because the seal had tagged it when the customer recieves it.
Whenever listing things for sale anywhere - always assume an idiot will look at it, tends to make me cover everything to keep safe, and covers yourselfInside me lives a skinny woman crying to get out - but I can usually shut her up with cake!0 -
It is really easy to leave feedback on Play.
Click on 'my account', followed by 'order history' and there is a big green button that says 'Leave feedback' against each item.
I only have 13 feedback out of 172 sales.
