Personally I would concentrate on getting a POPLA appeal posted in the morning that has the usual winning points (no GPEOL and no Standing/landowner authority, dodgy signage, no contract with driver), with a heartfelt covering letter. All securely stapled together with the 10 digit POPLA code on EVERY page and with a POPLA form (tick all boxes of appeal grounds except 'stolen car'). Make sure your covering letter is the top thing (when I say 'your' I mean the registered keeper who is the person appealing).
Thank you once more.
Do you think it is also worth a shot at adding in a line regarding the fact that she was told that she could park there by the attendant on a previous occasion (as contravening section 9.1 of the Code of Practice? - or should I just stick to the basics?0 -
No just stick with the stock letter to them. Remember to get a free proof of postage from the post office, not recordedWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Will do then. Thanks.
Finally (I hope) in terms of providing evidence, such as photo's of signs. If I understand correctly the advice is NOT to do this as it is on UKPC to prove that the signs are correctly placed?
Thanks again.0 -
That's right.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Excellent. Thanks for taking the time to help this Newbie out. It really is greatly appreciated.
I have the POPLA Letter written just working on the cover note and Application form.0 -

If POPLA reject it as 'too late' then email and ask for the Lead Adjudicator to review the matter. By the way, the family would need their heads examining if they want her to pay this scam. There are ENDLESS threads here about people laughing at the whole DRP/Zenith letter chain - no-one PAYS!
Heard back from POPLA today, and they have rejected the appeal, stating it was past the 28 days, but not mentioning anything about even looking at the extenuating circumstances.
So I'll now sort out an email to the Lead Adjudicator - is there any advice you can give to help word this and should it just then go to the POPLA's normal enquiries email address?
Many thanks.0 -
Just put the same as you put in the covering letter and say they appear to have overlooked the reason for the slight delay. Use the usual email address, yes.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Coupon-mad - thank you again.
Email has been sent.
It looks to be that, despite having stapled everything together the documents were unstapled, stamped and then reordered before presumably being handed to an Adjudicator (we had the documents returned with the POPLA letter attached, and in a different order to that which was sent).
Update to follow when we next hear back.0 -
Just to let folks know my girlfriend received a letter from POPLA yesterday stating that her appeal had been allowed. UKPC didn't provide any documentation to support their claim apparently.
I have now posted in the POPLA Decisions thread with a transcript of the decision.
Once again to any and all of you who provided responses and help; thank you. To say she is relieved is a big understatement. All your help has been greatly appreciated.0
