i live in a terraced house with assess to the rear for four properties,i am the second along the row the first being a shop.the forth along has an unused garage that embarks on the assess path by around 2 foot,the assess is around fifteen feet wide .i also have a garage but theres no way either of us can get a car in as theres not enough turning space.anyway the reason i ask is that on my title deeds it shows my boundary to be six feet further in to the alley/assess way,and i want to erect a new fence and take a few more feet like my fourth in the row neighbour has already done years back,can i just do this or do i need permission. yours confused linda

You may own (and be responsible for maintenance of) part of the shared access way, but that doesn't mean you can fence it off. The other properties in your terrace will have a right of access over the land which you will be obstructing if you put up a fence to enclose it- usually there will be details somewhere stating that the access has to be maintained to a minimum size.Common sense?...There's nothing common about sense!0
