Boundary fence

Hi All.
My neighbour and I share a common rear fence which is knackered. They want to replace with a cheap timber fence, I want to build a brick wall, more expensive but will last forever. My neighbour has Ivy on their side which has ruined the existing fence, as Ivy does.

If we can not agree to replace the fence, can I build a wall just inside the existing fence and leave the fence just to disintegrate? The wall will be just 2 inches inside the fence line, will be no higher than the existing fence, and will be pointed, built properly and painted.

  • Yes, you can build the wall if it's on your own land, although obviously you have to pay full cost and they can remove the fence and gain the 2 inches of your garden. I assume "forever" is an exaggeration though :)
  • Well maybe forever is a long time, but I just want a wall that will last a lot longer than a fence which will rot out in 5 years or so with the flippin ivy eating into the timberwork.

    And how do you hope to point the side that is only 2 inches from the fence?

    If it is a boundary between two properties then it would be best to agree between the two of you what would be correct solution, as a material boundery.


    To go ahead without agreement would be bad manners in my opinion.

    I would have thought that people would jump at the chance of getting a free brick wall built to replace a fence. Maybe they might even offer to chip in with the cost.
    I can afford anything that I want.
    Just so long as I don't want much.

    & how do you propose to keep the fence up while you are digging a trench for the foundations ?

    A wall will not change the ownership of the land, even if it's only 2"

    Given time and change of owners it soon gets forgotten that one house built the wall on their own land especially when the deeds show it as a party wall and lo and behold the wall becomes the boundary
