Very quick question regarding "reset of ticket"

I am currently addressing a car parking ticket which was issued to my ex partner. I was driving her car, got a car park ticket from a camera operated ticket system and the ticket was posted to her as the registered keeper.

She ignored the ticket as she thought this would go away and it got the Excel threatening with court action. She then made them aware I was the driver, gave my address so that the liability went over to me.

As far as I've read on previous threads this should have initiated a reset of the ticket. Instead excel just forwarded the last letter they sent to her where they are telling me to pay £100 before end of April otherwise they will take me to court.

Can they do this? From what I've read they should be giving me evidence of the offence via photographs, the opportunity to appeal and pay at a discounted rate.

Any help would be greatly appreciated.

    I'm pretty sure naming you as the driver resets the clock. Have a look at the sticky thread for Newbies that has all the information you need to appeal this fake charge.

    Yea I've read through that and it does state it will reset the clock. Just excel haven't seemed to do that. I can only assume it is a scare tactic to see if I will pay. Just want to be sure before sending a reply via email asking them to follow proper protocol.
  • Just send them an appeal, as the driver. If they reply that you are out of time then complain to the BPA with a copy of YOUR first letter from them.

    Scare tactics are how these scammers work. You can trust that everything you read in the sticky threads is true and correct, so tell the scammers they are non compliant with the BPA CoP.

    Here is my appeal, cancel the charge or give me a POPLA code, win at POPLA. Meanwhile, complain to the BPA. Use the template appeals in the sticky thread, don't try mitigation.

    Yep I would send them an appeal and start it by saying 'I refer to your letter dated xx/04/14 which is the first notification I have received about this matter. In the interests of resolving this and moving the matter on to my right to appeal to POPLA, here is my appeal as I believe that I was driving on this occasion even though it was several weeks ago and you have not furnished me with a PCN at all. I assume you will now rectify this omission in your reply, otherwise I will never have seen the details of the allegation about this parking event which would be a breach of the BPA Code of Practice'....

    DO NOT use words like 'you should have reset the clock' because obviously that's our forum-speak!
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
