POPLA Appeal Success

Hi everyone.


I thought I would let people know that I have won my appeal to POPLA against Parking Eye Ltd.


In January 2014 I was sent an invoice in the post for parking at the hospital in Burton on Trent. I appealed to Parking Eye and they ignored my appeal points and told me I had to pay. I asked for a POPLA number as I intended to appeal.


I used the process I found on this site and it works. The assessor at POPLA was Christopher Adamson. The decision is very concise and reads as follows:


Reasons for the Assessor’s Determination
It is the Appellant’s case that the parking charge notice was issued incorrectly.
The Operator has not produced a copy of the parking charge notice, nor any evidence to show a breach of the conditions of parking occurred, nor any evidence that shows what the conditions of parking, in fact, were.
Accordingly I have no option but to allow the appeal.

    Well done daisymeg on two counts, obviously beating PE at POPLA, but also doing this from working with the information provided within the forum :T.

    PE run scared again; can't put up a decent case against a forum fuelled appeal. Maybe they should look to employ some kind of competent lawyer to help them develop a much sharper approach to handle the lay-people beating them on contract law at both POPLA (in this case) and at court (in an ever increasing number of small claims cases).

    But, hold on.......... :)

    Yes, they need to employ someone who is competent. I was prepared to go to Court in relation to this matter.


    I was actually told by a Parking Attendant at the hospital that I did not need to pay and then, less than a week later, the jokers sent me a £70 invoice.


    What really annoys me is, people go to hospitals for a wide variety of reasons and to be sent a £70 demand to park for less than 30 minutes is just not on.


    Well worth taking the time to find out my rights and use the step by step process on this site.

    Nice one, I really can't see why hospitals put in barriers and pay on exit machines.

    They keep every penny raised and don't get the bad press involved with signing up with companies such as Parking Lie.

    I was listening to BBC Radio Derby and they had something on about Burton hospital (Clips of phone in's) and I just couldn't believe half the crap I heard.
