Accident at a restaurant

  • If the restaurant sited a table and chairs on a raised area without space to get up without falling down the 8" step onto an area which definitely sounds as if it should not have been in that condition, then they are liable.

    Bearing in mind it's hearsay I would be surprised if the raised area is inherently dangerous and caused the accident. I suspect the aunt simply lost her footing.

    You would have to be incredibly short sighted to go to the trouble of building a raised area that is too small to safely accommadate a table

    They could have been trying to squeeze in extra tables to cope with the holiday rush.
  • Was your Aunt forced at gun point to accept this table? perhaps your Aunt could of spoke out and refused the table had she not been happy with the location of it.

    Indeed they could.

    Experience on forums and in real life dealing with this type of thing means I find it more likely there was not a problem with the raised area. People have a tendency to want to be able to claim compensation and not know the full story so when they tell the forum tend to fill in the gaps they don't know

    My aunt has been allowed home, she received 9 stitches to the injury, and is in pain. The paramedics who attended said "it was an accident waiting to happen and that it should have been cordoned off". I will take on board all comments and feedback, I think we will speak to a professional shortly and see what is advised. However we are going to speak to the manager of the restaurant (it is a chain of public houses) and maybe the H & S dept of the local council. No staff came to give first aid even though they had been made aware with the screaming. The bracket was knocked with a hammer so it didn't protrude as much after the incident.
  • Having worked in hospitality I find it just as likely that they had been having work done in the area, and at the last minute the team had to ready the area. Shoving tables in as they saw fit, bits of kids with no foresite or awareness.

    Be aware that by professional help you mean seek the advice of a solicitor. You will find many (Especially the ones who advertise on TV) will tell you anything to get you to sign up with them as they make fairly good fees from a claim.

    If you decide to go down the legal route, take your time to investigate who is best for you and if there will be any charges to you. Be prepared to be dealing with people who are skilled at selling, do not be afraid to tell them you will need to think about it and will call them back.

    Your aunt has three years to make a claim so there is no major immediate rush

    They have undergone a refurb recently, but I feel that if the radiator had been removed, so should the brackets. The seating area is fixed and I have now seen a picture of what it is like. It is a table and church bench type seating, with the entrance to the seating flush with the edge of the raised area.
