Advice please from Consumer Law expert...

So I would really like to gather the input here of anyone on this forum with good consumer rights knowledge.

In a nutshell MET Parking have been issuing tickets on railway land citing Byelaws, PoFA AND RK liability and stating that the RK was liable. Of course they arent as its land excluded under the PoFA and in Jan 2014 I finally got MET to admit to this 'error' in writing - they cited that it was an 'unfortunate incident' and a result of a '...recent computer glitch...' .

Unfortunaltey for MET however i have been writing to them for over a year asking them to explain why they were citing RK liability and Byelaws side by side on the same pieces of correspondance and issung the Notice to Keepers on railway land and they refused to respond to me until Jan 2014 when DVLA got involved.

The final position now is that following a so called 'thorough investigation' (!) by DVLA , MET have agreed that they will they will cancel tickets issued in this incorrect way but ONLY since Jan 2014 '....when they first became aware of this computer error...'

Unbelievably DVLA will NOT require MET to issue refunds to anyone earlier than Jan 2014 event though MET were missiuing all of these tickets and letters going back to the introduction of PoFA in Oct 2012.

My question to the legal minds on this forum is , do MET not have a DUTY under some consumer law to contact these older consumers and issue refunds to people who have been sent these incorrect RK demand letters on dates prior to this Jan 2014 ? It's not in dispute that MET were doing this for over a year as the letters and evidence showing it were presented to DVLA and MET and they now seem to be hiding (with DVLA) behind the fact that they are only going to refund customers since Jan 2014 when they claim they first noticed this error in the paperwork. Does their duty not extend back in time once they have been made aware of their previous error in misissuing the letters and tickets ?

To put this into context the numbers of RK letters issued probably run into the tens of thousands..........

Parking Prankster may also be commenting on this case soon as i am happy to pass over copies of exchnages etc with MET and DVLA for his publication

    Well you could try referring your success with this to your MP, local paper and the local Trading Standards, also Passenger Focus and the TOC as a formal complaint.
