Hi, I am not bothering with a new A/E for this, as it isn't for me, asking for a friend.
They need to apply for an occupation order to keep someone from returning home.
What we can't seem to find out is how much this will cost. Assuming that legal aid is not available to them for this.
Does anyone know:
A, How much will it cost to apply?
B, How easy is this to apply for without the use of a solicitor?

Hi there
No personal experience of this. However Shelter and Women's Aid have lots of online advice. Presumably the Citizne's Advice Bureau might be worth a shout?

They're not easy to get as the courts view them as draconian.
What relation to your friend is he? Husband, ex etc. What are her reasons for wanting to prevent him returning home? Does she have a legal right to occupy the property or not?
Has there been any harassment or domestic abuse? If so, she may need to also apply for a non molestation order, which would be legally aided proved she is eligible based on her income. Obtaining a non mol could also increase her chances of obtaining an occpation order.

Thanks double mummy, but no costs are mentioned in the link, we have already looked at shelter, womens aid etc.
its a man wife scenario, joint mortgage, 1 child together plus step children.
emotional abuse has ended the marriage but the emotional abuse continues.0 -
