39 days and no response to my appeal to SMART PARKING LTD ?

Hi members, as a follow up to an earlier post, I submitted an appeal using the template letter on the newbie section of MSE's and sent it to SMART PARKING LTD using their website/online appeal process.


I sent my appeal to them on the 10th MARCH 2014 and have not had any correspondence whatsoever since.


What should I be expecting to happen from this point ??


Has my appeal gone in my favour ?

    You should get an acknowledgement within 14 days, and a decision within 35 days.

    I'd be tempted to email them saying that as there has been no acknowledgement within 14 days and no decision within 35 days (of the appeal), in contravention with the BPA Code of Practice, then you consider the matter closed. (Attach a copy of your appeal email to prove you appealed and when).

    Did you post it with proof of postage? I would put a wager on them saying they haven't received any appeal and the next you'll from are debt collectors.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    In brief, either a rejection (plus POPLA code) or an acceptance of your appeal.

    Several PPC's seem to believe that the deadlines established by their own trade body are irrelevant and play things their own way. unSmart are one of those.

    I would write a brief letter, enclosing a copy of your original appeal to them, telling them that you expect a response by return either upholding your appeal (and a cancellation of the PCN) or a rejection of it together with a valid POPLA code. Tell them that unless you hear from them within 7 days that you will consider the matter closed.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(
