Hello, hopefully someone here can help me with this

long and short of it is I took a 5k loan out through WF in Sep 2005, to be repaid over 4 years making a total of 11k, after 3 years Sept 2008, I stopped paying, leaving a total of about 3100 ish.

they chased me with letters etc, calls, but I ignored them and eventually moved house, they tracked me down, and issued a ccj against me, I wrote to the court appealing the decision, and they sent an incomings and outgoings form, I filled that in and sent it back, they then asked me to attend court for questioning, I managed to get out of going, by having a works medical and sending paperwork to the court, this was Dec 2013, they said they would write with another court date, I moved house again in Jan 2014, and have periodically gone to the old place to get post, they gave me a card for an undelivered item from a company called APS, I rang them, and they arranged another delivery date for Sat just gone, they didnt arrive but called to re arrange delivery for today, when they came today they bought the wrong paperwork, and have rescheduled for a week today, having googled the company it seems this is likely to be a court summons, do I accept the paperwork ? duck and dive ? will the debt become statute barred in September 2014 and thats why theyre trying so hard to get me in court ?

I feel that paying 8k back off a 5k loan is more than enough, I was also missold PPI at the time which I havent claimed yet, can anyone help with this one please, I really dont want to have to pay them back another penny

    I think the key point here is that you took out a loan and agreed to pay back 11,000.

    Welcome stuck to their end of the deal. These companies aren't charities, they don't lend money for free!

    No. The Limitation Act 1980 states "An action founded on simple contract shall not be brought after the expiration of six years from the date on which the cause of action accrued." They have already brought the action; your delaying tactics are simply putting off the action coming to a conclusion.

Alternatively, you can contact the FSCS customer services team on 0800 678 1100 or 0207 741 4100 to ask for an application form to be sent to you to make a claim for compensation.

  • thanks for the constructive advice, I know now well end up in court arguing it out, but I can try and hit them for PPI

    As they already have a CCJ then the loan will not become statute barred. Putting it off will not help and may well P off the court. Just because you have decided that you have paid enough does not make it so.

    The time to decide whether you were happy to pay back the amount or not was before you took the loan out. You don't get to choose now to welch on the deal, and as you've seen, the courts are going to enforce repayment.

    You are probably too late for PPI now, so you'd be better off working out how to pay back what you owe rather than wasting money on this.

    Edited to add, what exactly are you going to "argue in court"? "I borrowed money, agreed to pay it back, but blew it on chips. Please can you find in my favour?

    Avoiding the issue is doing you no good. A CCJ is enforcable for 12 years.

    I would actually love to hear you 'arguing it out' with them in court. Go on, humour us. What would your defence be?

    Any PPI refund will be put towards your outstanding debt.

    I think they're trying so hard to get you in court because they think you don't want to pay them back? If someone owed me thousands, I'd probably do the same.
