I was just wondering if anyone has heard of dealt with this company.
My partner bought a franchise from them but they are not fulfilling their side of the deal.
All our enquiries must now go through their solicitor (who is an extremely rude man!)
We don't know where to go next

Have you got the agreement on paper? Can you show they're not upholding their side of it? If so, sue them for it.0

I would second that.
My company shows a negative net worth, but is ultimately profitable, as is shown on the accounts.
Never invest in something that you're not 100% sure of.

Oh dear. I wish I knew about this site a year ago.
Basically my partner paid for a mobile phone charging and breathalysing franchise. Their part of the deal was they would find sites for the items, put the machines in, keep him regularly updated.
everything was fine at the start but they went over their time limit to find sites, plus the IPhone chargers kept breaking. Breathalysing machines kept breaking. There were other relatively minor things. We sought solicitors advice and threatened to take them to court as the machines were not fit for what they were sold as. Their solicitor counter sued my partner for harassment etc etc
Eventually (we just cannot afford legal fees) they agreed a new agreement. New sites would be found with new machines. 13 weeks later we still have no new sites. No one at the company will speak to my partner and he is always transferred to their solicitor, who I said is very rude and intimidating.
I think that even if we took them to court, they wouldn't pay us. Going by past history, which I just read on the other threads, I assume she will just shut this business down.
Frustrated is an understatement0 -

I'm sorry but I can't seem to understand what your partner actually does in the business? They're finding the sites, supplying the machines and keeping him updated... what is he doing? It sounds more like he has invested in a company, not a franchise.0 -
I think franchise is the company stretching the term a bit-an investor pays a healthy premium to own site machines based on the operators projected figures. If it was as profitable as the operator says, they wouldn't need small investors, they'd just run the network of devices IMHO.
Can your husband take physical delivery of the devices he owns and either site then himself or eBay them and cut his losses? Basically to stop feeling with this company who don't sound particularly like they're on the investors side?0 -
Once the machines are sited, we then get advertisers on board, the machines have screens on the front with rolling advertisements.
I think we need to put this down to us not doing our homework properly and a big lesson learnt0 -

As above, why would you not purchase the machines yourself and site them appropriately?
Not wanting to be rude here, but I just don't understand where the profit is in letting someone else do that for you, as it's cut throat enough anyway.

Have you tried small claims court? Did you ask to speak to any other franchisees before you jumped in? What does their lawyer mean by your partner harassing him.
Can you expand on the sentence about running out of time to find sites for the machines?
And what does it say on your agreement with them?0
