Really stuck and not sure what to do

I received a parking ticket 22/01/14 for going over ticket by 13 minutes...

I've tried reading the sticky post things but I don't understand any of it and am new to forums!

I ignored the ticket as it wasn't the council and was just marked as a Parking Notice not a Penalty. (I was advised by a few friends that they too had ignored them by this company and had no issues)

The company LPS sent notice to keeper on 26/02/14 and now I have also received a letter from Quest Debt Recovery Ltd stating final demand...

The issue was I don't normally park in that car park due to several health conditions but the car park closer to town was full. I was going to an appointment and I didn't manage to make it back to the car in time, the guy was at the car and I tried to explain that I struggle to walk that far due to disability and health conditions and he said it wasn't his problem and was very unsympathetic.

Any way we don't have the money to pay due to neither of us currently working. We don't even own the car any more due to our financial state and am lost at what to do.

Please if someone can help or tell me what I can do to get this sorted. I don't want to end up in court!

Thanks

mitigation wont help as all these companies want is your money

just read the newbies thread at the top of this forum as it has everything you need to know about these parking companies , the appeal system , debt collectors etc

frankly , what you want here is not relevant, by ignoring the parking ticket you run the risk of court proceedings so that door is already been opened , the 2 ways to close it were appeal at the time, then appeal to popla , and/or appeal to the landowner and get the ticket cancelled

so go with appealing to the landowner to get it cancelled , quoting the Equality Act 2010 etc too (lay it on thick), and leave the DC issues until you get an LBC or court papers

if you ignore an invoice from a local plumber he could issue an LBC or court papers, so this is no different , as its a parking charge invoice, and we all run the risk of the small claims court if we ignore these things

so in future, appeal, and get help here to do so , do not ignore these things "hoping they will go away"

what you SHOULD HAVE DONE is come here in february and got our advice and appealed it then, within the timescales, this would have been easy to appeal and then appeal to popla and made it "go away" at nil cost , so ignoring it was a terrible decision and your "friends" should be ashamed of themselves for giving out such bad ill-informed advice !!

not owning the car anymore is not relevant either , nor are most of the other points you raised (sorry to be blunt but better that you are fully informed , seeing as you asked !)

For info, in the year 01/10/2012 to 30/09/2013 LPS raised court action exactly ZERO times.
  • I have tried to read the information but due to my health condition (which is why I havn't done anything sooner as well) I can not understand it.

I don't know what to do and need help this is why I am here.

What I should of done wont help now...

How do I find out who the land owner is?

Whats a DC issue? I don't understand forums etc and am struggling which is why I have come here for help

You would appear to have 4 choices.

    1) Ignore them. As to date all this company has done is send out threatening letters. They say they will take you to court, send round the boys and all sorts. The truth is up to now they never have done.

    2) Have a stab at doing an appeal yourself.

    3) Asking for an appeal to be done for you by someone like Parking Prankster. There is a small charge for this but it makes it all go away.

    4) Pay them.

    I wouldn't advise doing 4.

Parking Tickets Appeals Service - they might be able to help you. However you may be too late for them to help.

(Link is to Parking Prankster's blog - not direct to PTAS).
  • Thank you to the helpful people!

I've contacted the parking appeals people and they are going to look into it.

Thanks again to the nice ones helping me when I don't understand

Nobody has been unhelpful or not nice in this thread.

Your inability to properly understand the information provided (whether for medical reasons or not - and remember this was unknown until you mentioned it later) did not make those posting it unhelpful or not nice.

I'm glad you seem to have found an avenue to get this sorted. (And it was for people like yourself that PTAS was founded). :)

I'm sad that you felt the need to take a dig at people trying to help in this thread. :(
