the paperwork says 'the fee reserves the property exclusively for the purchaser for a period of 28 days by which time exchange of contracts must have taken place. the fee is strictly non-refundable in the event that the purchaser does not proceed with the purchase of the property within the timescale set.
    sounds like i am screwed!!

No you're not. You are entitled to a cooling off period despite what the contract says. Demand you money back. It was less than 24 hours. Threaten them with small claims if they dont comply. How did you pay? Cash or card?

We were in the same boat as you.

I emailed head office and explained to them our reasons to pull out and after a long chat I had to visit the new build office on site for them to refund my card.

Just get it in writing and you will be fine.

Follow up first letter with second letter and post from 2 post offices with proof of posting.
Email head office as well and find out who is CEO or Chief Exec,
    Threaten them with small claims.
Did you pay with Credit card ?

found out the name of the CEO and sent the letter to them but apparently the sales rep who we dealt with said he had tried to reason with the company director but they were insistent that it was company policy! very shamed to say i paid in cash - wish i had my cheque book on me but again was in a state of hypnosis on this house and all common sense went out of the window!!

Pretty much agree with the majority here. No way can they keep that money! I am 100% certain that every agreement for anything and everything has a 'cooling off period.' (Usually for 7 days.)

The guy is bullsh1tting you. Company policy my @r$e! Did he even really SPEAK to his 'superior?' Go the the CAB, or even trading standards.

Thanks for all your support on here today, you really have made me feel better. I felt so stupid and heartily sick and just thought i was a lost cause but thanks to you all, i feel as if i have a case and will try my best to get the money back. I am on a mission now!

Good for you Parks. No way should they keep this money. Like I said, go to CAB or preferably Trading Standards and register your complaint TOMORROW, because they are not open again til Tuesday, possibly even Wednesday and it may be too late to register a complaint then as your seven days will be up.

Hope you get it back. Don't feel stupid. We all do things without thinking sometimes.

    Good luck.
