Bit of help required

Hi guys, this is my first post here..I'm having a problem which I'll explain to you..

Having to work 6 weeks in hand for my new job. Went to the bank, explained the situation and they would not

1. Increase my overdraft
2. Issue me with a loan
3. Issue me with a credit card

Some time ago, my Mother took out a Barclaycard in my name, behind my back, as she !!!!!! all her finances up and had to declare herself bankrupt. She got my brother to ring up claiming to be me. When I found out, I hit the roof but let her continue with the card if she made sure it was repayed on time.

I've never needed this card personally until this time, I rang up yesterday to try and increase the credit limit on it to get me through the next few weeks but can't for another few months as she made a late payment icon_rolleyes.gif

I'm a bit stuck now, I really am going to need an on the spot loan of some sorts. Any advice would be appreciated

To top this all off, mother had taken out an Argos and Freemans account, in my name, without my knowledge until I eventually discovered a few months ago AND is kicking off with me because I told her I wasn't happy about the whole situation as that late payment will have probably been one of the things on my credit check from the bank which meant I couldn't be accepted for a card/loan.

Honestly..stressed and !!!!ed off!!

    my god, dies your mother know what she has done to your credit rating??

    thats really bad of your mother, sorry if that sounds harsh but i would take things further as its gonna ruin your credit for at least 6 years!


    believe me i know how that feels as i have had similar done to me and i had go to the soliciters and get it sorted!

    I'm being left without many other options to take it further, which would probably leave me without a home although at the moment I'd rather not be here anyway!

    I really don't think she understands what she has done, but she bloody should because she has completely ruined her own credit rating, hence why she has had to deceptively get accounts on mine for her own use :mad:

    I read somewhere (possibly on MSE) about people taking loans with others but not with a bank or financial institution. Can't remember what it's called. I seriously wish I could remember the name!?!?!

    As for your Mum getting credit (actually debts) in your name. You know it's illegal and what I'm about to suggest could harm the relationship with her - but it doesn't sound very good as it is.

    I think you're limited as to doing anything about the Barclaycard as you called up and asked for an increase. However, I strongly suggest that you call Argos and Freemans. Explain the situation making it clear you had no knowledge that your Mum was using your details and demand that those accounts be closed with immediate effect and state that you will not pay any outstanding balance and that you want an investigation. If your Mum misses any more payments (which seems likely as she's already done that) then your situation just gets worse.

    If you haven't already done so I'd also have a strong word with your brother!!

    As soon as you can afford, contact all 3 credit reference agencies and make sure that everything is as you expect it to be. It costs £2 for each file.

    That said, how much money do you NEED for the next 6 weeks.
    Travel - can you walk, if not monthly bus/train pass?
    Food - make your own packed lunch?
    Phone - use only for strict emergencies until you've money coming in?
    Roof over head - you sound like you're living at home and if so I'd suggest you live free until you're working again.
    Could you borrow from your brother?

  • I did know that she was using my details for those accounts, but not until a while after she had opened them without my consent. She took them out without my knowledge just as she had the Barclaycard.

    I've managed to get some money sorted to see me by for a while, my mate has been excellent and transferred some over into my account so I'll be covered for upcoming bills and stuff. Sorted out the repayment scheme aswell which as you'd probably expect is nowhere near as harsh as it would have been with an official company.

    So, just to clarify. I had no knowledge of any of those 3 accounts being taken out in my name with my details, but when I did find out I let her continue to use them under the instructions everything had to be paid off on time so my credit wouldn't be harmed. Now, as I allowed her to continue with these accounts when I did find out, would I be able to still report this and have my credit rating cleaned up a bit!?

    I'm not very good with these things, it's all a bit new for me!

    I would contact all 3 and explain that the accounts were taken out without your knowledge. Depending how the conversation goes would depend on how much I would tell them (ie not sure I would tell them that I allowed her to use the cards after the fact). Tell them that you know that payment(s) have been missed and it has been marked on your credit rating and you want to have that removed.

    Have you asked your mum if these 3 are all the accounts taken in your name?

    Is money owed on the accounts?

    Do you use them? If not arrange to close them making sure that you are requesting they are closed due to being falsely opened. You may want them in the future.

    Money is still owed on all 3 accounts yes. The only 1 I've used is the Freemans one to get some trainers and other items, but she has made the bulk of the use on this account.

    As far as I'm aware there's nothing else in my name but I've not really asked her straight out about that. So, if I was to ring up and state to these companies she had falsely used my information to set up an account in my name, what would the ramifications be for her?

    Honestly, I don't know. I would suspect that in the circumstances that you can state that you have no wish to press any charges against her legally but that you want the accounts closed and to ensure that any money owed is paid by her. They would need to agree payment terms with her directly. Could you make a phone call in the presence of your mum so that they can speak with her during the same call?

    I would hope that your mums credit file is affected even more than it is already but that yours is not recorded against for missed payments on these accounts.

    If you take no action, your mum may do this again as it looks to her that she can soften you up. You also end up with a bad credit record for 6 years because of her which is wrong on every level.

    Now, I'm no legal expert, but isn't getting credit/opening an account under someone else's name fraud, and therefore a criminal act? Once you inform the credit card company that your mother and brother opened the account in your name, I would expect them to immediately inform the police - whether you want to press charges or not!

    This is a very difficult situation, but I would suggest you inform the creditors that the accounts were opened fraudulently, and request that all accounts be closed and the details struck from your credit history. At the very least, I would expect the creditors to rename the accounts into your mother's name, thus removing you from the debt.

    It may sound harsh, but you should not have to suffer for your mother's inability to manage her finances!
