Mannheim came out to inspect the vehicle which I was told 1,098 was to be paid for damage which was ridiculous! Most was couple of rust bits which were there when I bought the car I phoned asked for a breakdown of the figures, apparently 75 pound per alloy wheel. Anyway I was in dispute about prices so they defaulted me January although I paid that month, also a default on February . Motonovo and I came to an agreement mid feb that 350 I would pay to clear the current liability, which was paid. Checked my new credit report which gets updated every 4 weeks only to find a default on March. I've contacted the FAS which are allowing motonovo 56 days to resolve the matter but with these defaults on my name I cannot get a morgage after putting a reservation fee down on a property! Didn't think it was allowed to default as I have never missed a payment on the car.
Worth noting that if you have to refer to the FOS or ICO, it usually takes months. That's on top of the 8 weeks Motonovo are allowed to get you their final response.:beer:0 -

Check --- for the DPA, and --- for the guidance on issuing defaults.

Really useful, thanks for this.
It makes me wonder though, Motonovo have pretty much just done themselves out of the money I owe them, as if they don't remove the default, then what incentive do I have to pay them (or the debt collection agency they will no doubt sell it on to). My credit will be ruined anyway now.0 -

Yeah I know, well I gave back my hire purchase vehicle to get a new car with motonovo for double what I took the KA out for! I've also been told with this default on name I can't get another phone contract when it runs out.0 -

If you stay with the same provider, there's nothing to stop you getting anything, as there's a good chance that for many things, it won't affect any arrangements you already have (although other credit may be more of an issue)
In the case above, there would definitely be recourse to have it removed, from the facts presented, however this will be on a case-by-case basis, and this is important to remember.

Who told you about the default and the mobile contract?
If you stay with the same provider, they don't usually credit check you again.
I changed provider and have a new phone contract with O2, which I can see the credit search for on my file. I have a stack of defaults.:beer:0 -
Yeah it does seem strange as I've actually just upgraded my phone with Voda and all was fine.
Even stranger was that I just applied for a loan on a MacBook through Apple (Barclays) a few days after the default was added and it came through fine on the credit check, not even a manual referral.0 -
Just a quick update, I've sent a file to the financial ombudsman with all my (copies of) paperwork, recorded delivery slips, credit report, letters from Motonovo etc. and CC'd Motonovo into it to lodge a formal complain with them.
Will wait and see what comes back.0 -
A quick question, what is the best way in dealing with the collections agency Moto have appointed? 'DWP LLP', they have tried contacting me (email phone and post) regarding the balance.
I'm wary of getting in touch with DWP, as my issue is with Moto.
Any ideas?0 -

Write to them, tell them you only deal in writing.
Tell em it's with the FOS and you consider the account in dispute until the FOS have investigated. Translated as sod off:beer:0
