Help! ParkingEye Ticket!

Hi all.

New here, jut received a letter from parking eye saying in overstayed the 2 hour limit in a car park local to me. I used the stores in the retail park as per the car park rules, but didn't read anything g about a maximum stay, was there for 2 hours 44 minutes.

They want £50 if I pay within 14 days and £85 thereafter.

I've spoke to a few friends, one says ignore it one says appeal.

I have no idea what to do, never had a parking ticket from a private company before.

    Hi Brad,
    The friend who says appeal is right - ignore hasn't been the advice for over 12 months since the law changed allowing them to pursue the reg. keeper.

    But don't worry as long as you follow the advice about how to appeal that's contained within the NEWBIES thread ( 1st thread on page 1 of this forum) you will be able to get it cancelled.

  • Hi thanks for that, so I should make a soft appeal first via written letter sent with a proof of postage direct to ParkingEye?

    I can't seem to find any receipts from that day, pretty sure I (very rarely) used cash that day! Do I have to include a receipt. I could probably include past bank statement showings visiting the car park and using the facilities regularly previously.

    Do not provide any evidence to ParkingEye. If you find receipts etc then retain them but don't go giving them away.

    The objective of the soft appeal (as per the templates in the Newbies thread) is to have it rejected by PE who are then obliged to provide a POPLA code. Armed with that code you can submit a fuller appeal to POPLA and PE will pull their more recent trick and simply not bother to respond to it handing you the victory. Cost = A couple of hours reading/writing as opposed to a couple of hours reading/writing to PE followed by paying their demand for £85 anyway.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    As long as this was in either England or Wales
    Then yes send in the template appeal letter from the Newbies thread.
    The appeal is sent from the registered keeper and don't identify the driver if you decide you want to add anything to the 1st appeal letter - but it's fine to just send it as is.

    The circumstances aren't really relevant and you don't need to send in receipts or any other proof of purchase to PE.

    It's likely P E will reject your appeal to them - but that gets you the POPLA code and with the forum's help to put together your POPLA appeal you stand a better then 99% chance of getting it cancelled.

    Sometimes when P Eye are managing a car park for just one store (like they do with a lot of Aldi shops) there can be clauses in the contract that mean they must cancel for say a genuine shopper in which case it's useful to send P E proof of purchases but on a retail park the contract is more likely to be with a managing agent and not a store.

    But for retail parks it's still worth approaching the stores you shopped in (copies of bank/credit card statements will be ok as proof but make sure you blank out any personal details). Even if you didn't shop in certain stores that day but are a regular customer normally then go and speak to the managers - many can and do get these cancelled.

    And while you're waiting for your POPLA code use the NEWBIES thread to gen up on winning POPLA appeals.

    Would i be better to pay the £50, i really cannot afford £200, i would not be able to borrow the money or get a loan for it. I have the £50 now and can take it as a knock and refuse to use the retail park again.

    This will get stopped at POPLA at no cost to you IF you follow the instructions already provided and detailed in the Newbies thread.

    THIS WILL NOT GO TO COURT .... if you follow those instructions.

    EDIT - just to add, Parking Eye are lying with that stat. Ask them how many they won since last October !
