UKCPS parking fine help!

Hi guys, I've read the newbies thread and a number of threads regarding this matter, so apologies if I have missed anything but I am really confused on my matter so any help would be appreciated!

firstly I received a parking charge (£60 rising to £100) on 08/03/14 for leaving my car in a car park for no longer than 30 minutes. I ignored it to begin with (stupid I know) and now they sent a letter to my parents house asking for £100. It says on the letter that I no longer have the option to appeal as 28 days has elapsed.

I don't want to just give away £100!

Basically just need some help on what I could do to make these go away!

If I've missed out anything that may potentially help then please do ask.

Thanks in advance guys!

First of all, read the NEWBIES sticky thread at the top of the forum and then come back with any particular points that you are stuck on.

I fear that few regulars will help unless you have read the sticky as it answers so much and we can hit the ground running when you come back briefed up.

please also note that the time to "make this go away" was the time when you ignored it, as the 28 day rule is correct

you can still appeal, they could still give you a popla code , but its ulikely , so sorry to say you missed the best chance you had, meaning you really need to follow the other advice , which is , get it cancelled by the landowner

what I am trying to say in simple terms is that you missed the flight, so you cannot get on it (like all those easyjet programmes you may have seen where the passenger turns up AFTER checkin has closed)

its not as easy to make them "go away" once your deadline has passed

sorry, the point im stuck on is the (Too late to appeal - you think?) part.

this may be stupid, but can i still appeal? if so what can i say?

the part that throws me is where it says - are you the keeper but not the driver? I am both so dont understand what grounds i will have to make a successful appeal.

again im sorry to anyone that reads but im really confused

ok, so that clears that part up then.

at the bold part, how would i go about this exactly if it was on a retail car park? would i just ring up a number from the website? and then what would i say to them?

again im sorry if ive misunderstood as its all so confusing to me

the reason you are confused is because each case is different and so you have to cover all eventualities

so in simple terms , follow the flowchart

lets assume you got the postal NTK, you have 28 days under BPA guidelines to appeal it (it probably tells you this somewhere on their paperwork) , this is when you should have followed the newbies thread and flowchart , not now !

    but you ignored it

so yes you can still appeal it , and they could look at the appeal and even grant it , or they could give you a popla code, but as they want their pound of flesh (£100) , they wont !! they want their money and by ignoring the NTK you have played into their hands

by all means appeal, but you wont get a popla code and they are unlikely to cancel either

so you have little option but to go through up to 6 years of worry as they may take you to court under the small claims service

had you been prompt about this and not ignored them you could have appealed in the 28 day window , and they would have been forced to cancel or issue a popla code

by ignoring that 28 day window, you now run the wrath of these people and they are likely to take it all the way

you need to get it cancelled by the landowner, or you are in deep do do

    or pay up !

ok, thanks for clearing it all up!

seems like the easiest option is to just pay up. just didnt want to pay up when there could have been another way to get out of it.

thanks for the help and advice though!

there was, in the first 28 days the easy way was appeal, then go to popla , or complain to the landowner and get it cancelled

you did nothing , so you have lost the right to appeal and popla , but can still complain to the landowner

in future sort it out quickly, and do not ignore , or you will face the consequences , ignoring these people can land you in court , and has done for some people
  • I hope that I am not being a tad stupid here but surely the OP is in line with advice on here:

    a) Ignore the ticket on window

    b) Appeal to PCN issuing company within 28 days after receipt of NTK
letter despite what it says in NTK about losing right to appeal.

    c) Commence POPLA proceedings when initial Appeal is knocked back.

I hope that is right otherwise I am in deep s***

no mention of a ticket on the window so I believed it to be a postal NTK so he had 28 days to appeal, but he ignored it, playing into their hands

but I did tell him to appeal anyway

It's simple to complain to a retail park and we have threads galore reporting success (but then I would have hoped you would have already read about that in the forum sticky threads). It's what the sticky threads are at the top for, important advice & details. You want 'Successful complaints about PPCs' in the forum stickies collated by Crabman and in post #2 it shows various UKCPS cases cancelled, often by retailers but also by Savills or whoever Google tells you the owner/managing agent is.

And...is this really the sort of complaint to be handled over the phone? Clearly a written /email complaint can be worded MUCH more strongly than dithering on the phone when fobbed off by the first person who happens to answer. Personally I would never recommend that most people do this sort of complaint over the phone unless you are a particularly assertive person on the phone who can sound businesslike, informed, angry and won't be easily fobbed off.

    You are joking, right?

I agree with Jailhouse John, you appear to have had the first letter after a windscreen PCN so why the panic, seeing as that's the NTK, the one to appeal to using the appeal letter in the NEWBIES thread. UKCPS are known for the NTK letters to pretend it's too late to appeal but if you simply READ the thing you will see that the keeper can appeal in fact.

I don't know why you are making this more difficult than it is and inadvertently confusing posters here by making it sound like you are at a later stage - you are not. You have an NTK like anyone else and I have written your appeal letter for you, in the NEWBIES thread. This is so simple, send the template appeal letter.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
