Niece received parking fine while helping me (disabled fell over dropped my debit card purse) Anyway she pulled up came to my rescue returned to car within minutes to be slapped with a £60 parking fine from a firm called parking awareness. There is a sign on the photographs with a blue P on it but I cannot read it from the photo, yet the sign next to it is 10 times bigger saying locks get your keys cut. So sneaky if you ask me, Individual parking bays but no clear sign of No Parking. Anyway immediately appealed (mistake I now realize, was hoping they would understand and quash it, but NOPE.
So I sent in the template letter at the top of the thread the sticky thread I read people talking about. They have just emailed me saying: You may only appeal your PCN once to Parking Awareness Services, but you may appeal to our Accredited Trade Associations Independent Appeals Service, please visit theipc.info for further information on how to do this.
I'm not sure what to do, there is a sign on the wall but as I say it was not as clear as it could have been specially being next to a sign at least 10 times its size, I will go round this evening and take photos as I cannot upload their webpics, and try to talk to the shopkeeper see if he can help.
If anyone has any templates they think I ould use and any advise please let me know.
Thanks in advance Bev xx

Has your niece already appealed the PCN then?0
-
ignore what I said, yes we appealed on the night of the ticket hoping they would quash it after explaining she had come to help me after I fell.0
-
In the reply to her appeal then she should have been issued with a IAS reference number.
Does the PCN make reference to a 'breach of contractual terms' or a 'contractual fee'?0 -
Ah yes they have given her a number on this email.

she is a new driver and none of us have ever had any dealings with these private firms. Had it have been the council I would have contacted my local councillor.0

Look at post 5 on this thread: https://forums.moneysavingexpert.com/discussion/comment/63857139#Comment_63857139
You'll need to remove the reference to Morrisons and swap ParkingEye for the company involved in your situation and just generally tweak it to match your circumstances.
I don't think the Equality Act will apply as you were not a driver or passenger at the time of the alleged infringement. I'm just doing some reading as the defence of necessity (or possibly self defence) may be available.0 -
I have gone on POPLA website to appeal and it is asking for a veriication code? Any ideas what this is? I tried the IAS number but it doesnt fit.0
