PCN - Urgent help needed

A PCN was received for our car 4 months after the incident date at an airport, the follow up Liability Notice 6 weeks later. The trouble is we moved abroad early this year and have just received the letters this week after coming back for a short stay. We will be returning in 3 weeks so am worried and not sure what the best action will be now that we missed the 28 day appeal deadline.

Any urgent help would be greatly appreciated as I would like to write or appeal asap.

Thank you

ps the incident was a 30 second pick up btw

Who is trying to claim the money and which airport ?

Appeal anyway with the template in the Newbies thread. You might want to add a point that stopping is not parking ( obvious to you and I but not so obvious to the morons that run VCS ).

If you live abroad then I would also tell them what your serviceable address is (i.e. your usual address).

This means that if they go down the court route and do manage to get a default judgment (as you may not realise that court papers have been served etc) you will have evidence that you told them what your service address was and that they have ignored that which would make it easier to get it set aside.

Also, they may just give up, as serving papers out of jurisdiction costs extra money.
  • Sorry how do i find the template or even the newbies thread ?

The Newbies thread is the sticky thread at the top of the forum (link for you: https://forums.moneysavingexpert.com/discussion/4816822).

The initial template is in the first post on that thread. Read through the rest of it and it will tell you what to expect.
  • Cheers guys I will go and do it now.
  • I seem to be reading that there is a time restriction for the PCN to be issued given that this was approx 120 days, do they still have any chance of enforcing it ?

Under the Protection of Freedoms Act no, but POPLA and the court seem a bit backwards in applying the service rules.
