Car hit from behind

Hi, just after some advice please.

On April fools day a driver went up the back of me on the motorway and then the one behind them hit him and he hit me again.

I was told by admiral I would not need to pay a penny as it was the driver behinds fault.

I then get 2 letters yesterday 1 from albany assistance saying n the 8th April the 3rd Party has said it was their fault.

I then get one from Admiral the same day date 10th April saying the driver is saying it his not his fault.

My car has been written off and Admiral now say they are taking £250 off my payout for my excess? but not to worry as I have a very good chance of winning and I will get that back.

They have also got me to see Doctors etc as I was hurt.

Does this sound correct that they take £250 off even though I was hit from behind?

any help would be great thanks.

    I've not been in an accident so I'm afraid I can't say for definite, but when my brother was hit from behind on the motorway, he had to pay his excess initially but then claimed it back when the other party was found to be at fault.

    Beware though, as it may take a while to get your excess back. In my brothers case, the person behind even admitted it was their fault but the insurers still refused to refund the excess due to "insufficient evidence to prove fault". It took over a year to get his money back.

    This could just be an unlucky case, but you should still get your money back if it definitely wasn't your fault (and being hit from behind is about as most non-fault as you can get, unless you were reversing!) :rotfl:


    For the future, it may be wise to invest in something like this:

    Mount it to your windscreen, put in a Class 10 SD card (not a lower class as this won't be as good video quality) and plug it into the 12v socket. If something like this ever happens again, at least you'll have video evidence that you were not at fault.

    Same happened to me had my medical expenses covered physio etc but at the time on being issued my payout for my car the 250 was taken off and as the person behind admitted they were at fault no charges were made by the police so I had no idea that I could reclaim this excess.
