Trying to sell flat - tenant has made it look awful

    Have you protected the tenant's deposit, assuming you took one? I only ask as not protecting it would invalidate the section 21.

    Marliepanda does make a good point. Even with a good tenant, them being there means anyone wanting to buy the home as their residence will not be interested. Even some BTL won't be interested, as they'd prefer to select their own tenants. Tenant in situ has very limited appeal.

    Putting locks on the bedroom doors does sound like your tenant is subletting, possibly not even living there themselves so I hope it all goes smoothly for you and that you get the place sold.

    Even if you serve a s21 giving 2 months notice, that isn't a guarantee that she'll be out in that time - some tenants will wait for the court order to arrive after the expiry of the s21. Even once the order has arrived some will wait for the bailiffs on the doorstep to evict them before they go....all of this can seriously hold up a sale.

    When I was looking for a house a couple of times I called agents to arrange viewings and was told 'I'll have to contact the tenant and see when we can get access' - my response was 'I've changed my mind, I don't want to view it, thanks anyway.'
    Common sense?...There's nothing common about sense!

    I don't think you realise that just because the tenant may be on 2 months notice it does not mean she has to leave then. If she stays you will then need to start the eviction process and wait for the courts to evict her.

    It would be better for you to start the process now and sell with vacant possession.

    The buyer will not be able to exchange until the tenant has gone as it has to have vacant possession for the mortgage funds to be released.

    Apparently if the the bedroom doors are lockable from the outside and the room is being rented out it means they are tenants. If there are no locks on the bedroom doors then lodgers - afaiw
