Help! Lloyds TSB PPI claim failed

Can you please help!

I have put a credit card PPI claim in with Lloyds TSB, on the terms of not knowing I had the PPI and that Lloyds TSB did not sell the PPI policy to me at the point of sale from the credit card application in 2006. The cover was pointed out to me by my new partner in 2012. The cover was canceled straight away.

I also did not know I had signed for the PPI policy on my credit card application in the smallest of writing, (I wish to purchase Payment Protection Cover) with a small electronic generated cross in a box, not hand written by me.

I was working at the time and was entitled to 4 weeks sick pay and I was on my own at the time. I also had 12 weeks off with a broken foot and wrist that I did claims for, because I didn't know I had the PPI.

The claim was rejected with Lloyds TSB and FOS because I signed the PPI line within the credit card application form and they said the product was right for me, I did not know I had it or was sold it!!

There must of been 1000s of others in the same boat, where Lloyds TSB's adviser would of said just sign (here, here and here)!! .

Can any one help??!!

    Credit card PPI shows on every monthly statement (where your account has a balance) on a separate line. That's around 90 statements!
    So your complaint was basically that you've ignored every statement since 2006 and have forgotten (or didn't read) that you signed an agreement to have it eight years ago.

    I'm afraid that your complaint was utterly weak. It's a myth sponsored by claims companies that PPI was routinely added without the knowledge and permission of the customer. You needed a far more robust complaint in order to be successful.

    You have no one else to complain to now and your complaint is over.

    A lot of that is not a valid complaint or is an unprovable allegation. So, it was a very weak complaint to begin with.

    So, it shows you had a financial need for it. That works against you.

    That is the logical outcome. unprovable allegations usually fail. However, they also have to look at whether it was suitable for you. In your case, it does appear to be suitable for you.

    And can you prove that happened?
    Also, if it did happen, then why did you not complain when you first saw it on your statement? If you complain within months of first seeing it, then your complaint is credible even if the evidence doesnt support it. The longer it goes on an premiums are paid, the less credible you are.

    Your complaint has been rejected by the FOS and by Lloyds. You have nowhere else to go.

    No point now looking for other reasons, your mis-selling complaint has already been rejected by both the Bank and the Ombudsman. It's game over, as already advised earlier.

    Did you tell FOS that you had a pre-existing condition?

    It would depend on what the condition was, its effect on you and what the policy says about pre-existing medical conditions.

    Just had a letter back from the FOS this morning, which say they now uphold my complaint to Lloyds TSB PPI policy, based on the new information of my medical condition, which was disclosed and logged with Lloyd TSB at the time of application, Yippee!!

    So -taff and Moneyineptitude thanks for all the smug comments. If you need any help and (diplomatic) advice in the future with PPI claims, please let me know, I am happy to split all commissions 50/50, Ka-Boom!!

    Well done.

    But in your first post you made no mention of pre-existing medical condition. You also said you only had 4 week sick pay which is pretty rubbish and only makes the PPI more suitable for you. You also indicated it took you 72 credit card statements until you noticed this.

    You need to give correct accurate information if you want an accurate answer.

    Well done for persevering with this. However, your mistake was not to include all pertinent information in your original submission to FOS.
    How long has this taken as a result of that omission?
