    Once the company has gone to court and bailiffs are appointed they then act on behalf of the court (Queen and country) which makes it a criminal matter.

    However, bailiffs, on many occasions do not follow proper procedure as laid down by the courts, therefore it should never be taken for granted that bailiffs are actually acting within the law.

    This rather long, but very interesting You tube video proves the points, but it's very interesting to see what happens if you stand your ground and know your legal rights ;)

    It doesn't become a criminal matter once bailiffs are appointed. It is still classed as civil dispute. Police officers may be asked to attend where there is a possibility that a breach of the peace might occur or any other criminal offence (by a debtor or a bailiff) may occur. They have no powers at all where the execution of the warrant is concerned.

    The rules for bailifs were tightened up in some areas in the last couple of weeks. Not nearly enough in my opinion. Not enough to stop them breaking the law and using some shocking tactics to obtain what they're owed :(
