Bit of advice needed

Hi there

Last year i helped my oh claim back his charges, we successfully claimed back all £6k from RBS no problem, the whole thing took about 3 weeks and was suprisingly painless

As this went so well i thought i'd help my best friend who has been suffering serious financial difficulty since being made redundant 2 years ago and being a single mother with a mortgage.

We got her statements and she is owed just over £3k from HSBC. She has already changed banks to RBS but her account with HSBC is still open as she has a CC and Loan debt (in arrears) with them.

If she wins any money and they pay it into her old acount can they take it away just as quickly to pay off her owed debts to them??

She desperatley needs the money to pay off a whopping council tax bill as this is priority, (don't think its been paid in a long long time :eek: ).

I'm just wondering if anyone can help me on this? Has anyone been in the same situation? Can HSBC take the money back?

Any help will be greatly appreciated

    I am afraid a bank has the right to offset any reclaimed charges against money still owed to them. You can ask them to send you a cheque, but I am not sure they will do this.

    Hi, i wrote a while ago asking about what will happen if my friend claims back her charges from HSBC but is in arrears with her CC and loan.

    The response was that they wil take what they owe, which is rubbish as she was going to use the money to pay off an overdue council tax bill but fair enough.

    However she has been in touch with me today and has told me that her debt had been sold to another company in December. Does this now mean that she dowsn't owe HSBC but owes someone else? Will they still have a claim on any money she may win back?

    Yes they still have the right to offset any monies claimed back onto the outstanding debt and will do so, any remainder would be paid to her by means of a cheque :)

    so if i am claiming from HSBC and i have a loan with them, they will automatically use it to pay off the loan?

    surly its my choice what i do with my money that they took from me??

    If you are claiming from the loan account yes, if you are claiming bank account or other account no. Each account is covered by seperate terms and conditions but if any are in default then yes 'the right of offset' applies,
