Hi there
Under what peice of law has it been deemed that these charges are unlawfu?
Would Section 25 2d of the CCA 1974 apply to it if so has anyone used this?

The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law.saffronflowers wrote: »Hi there

Also they must be reasonable under S.15 of the Supply of Goods and Services Act 1982.
Would that be it ?

Thank you for your reply - my problem - "crusade"!! is to stop bailiff companies from charging a percentage commision on top of debit card payments. eg in one case some one was charged £20.89 for paying by debit card. Their justification for this is that they need to cover admin costs. So therefore someone who pays by credit card pays a distinctly lower amount of their admin costs due to the bank charging a percentage fee to process those.
Would that apply to the above law? Sorry my head us swimming with different statuets at the moment.

This is a different issue to the majority of posts on this board. Companies are allowed to make an additional charge for payment by credit/debit cards.Gwlad heb iaith, gwlad heb galon0

Mark, I appreciate this however, it is also fair to say that Martin's addage that just cos someone tells you that they are going to hit you and then do that makes it lawful. My point being that by using a debit card you end up paying a dispproportionate amount as opposed to using any other method of payment. So I am just scouting around to find the peice of legislation that was the start of this process and seeing if it is applicable to this situation.
