Parking eye asking for evidence(read newbie thread)

Hi, I received a parking eye charge in an NHS car park, My hubby was visiting out of hours docs and I waited in car for him (approx 2 hours)
No idea it was pay and display as I never even left the car and there definitely wasn't a sign where I was positioned. Sent letter to PE explaining this and citing the signage rule and that the charge is ott. They stated that signs are displayed at entrance to car park and my defence was most people are watching where they are going not reading signs while their driving. They are now asking for evidence to back up my letter. What evidence do they mean? Are they expecting me to go back to the car park and take photos? I emailed the BPA to ask what their rules are on signage and how often these car parks are checked for compliance but didn't really get much back from them. After reading the threads I've also sent a complaint to the NHS trust. Should I go ahead with the initial refusal letter and ask for a popla code, they've said I have an extra 14 days to reply.

    You've already appealed, they I gather not supplied you with a code for popla, so make complaints to the bpa and dvla, they can't use this as fishing expedition, the dvla has already spoken on this below. But also write back to them saying there is nothing to add and supply a popla code
    “the following practices may be considered as Code breaches and must not be continued:
    • Asking the motorist to enter into additional correspondence to obtain a POPLA code
    • Failing to include a correct and/or valid POPLA Code within the Rejection correspondence
    • Issuing a POPLA Code with a date identifier which is significantly different from the date of rejection
    • Appearing to indicate that the issue of a POPLA Code is conditional on driver details being supplied “
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    I cannot see any reason you could give them as an excuse , so they are delaying things

    just send the template appeal in and mention you have nothing further to add , or preferably the one posted above by stroma

    then if and when they give you a popla code, use a popla appeal and adapt it and use popla to quash the ticket

    in the meantime you are correct in trying to get the hospital to cancel it , including PALS

    Just a few questions first to understand where things are up to.
    Did this happen in England or Wales?
    Was this originally a windscreen notice or a postal one
    Did you actually use the words appeal in you letter or was it just by way of complaint?
    Did you identify yourself as the driver?

    Colliescarer it was in England by way of letter. I used appeal, the initial letter is saved on my hubby's laptop, I know I used the term "I" in my letter but I can't remember if I specifically said I was driving, I know I made reference to the fact about signs on entrance and stating people normally look at the road when their driving. Is admitting you were the driver an issue?

    if you read the newbies thread you would know that you never use the term I or admit who is driving in most appeals, yes it can matter as by law the driver is the one deemed responsible as they committed the problem, so its better not to admit it, although its not the end of the world

    but whats done is done, so use the stroma reply and get your popla code asap
  • Stroma the haven't provided me with a POPLA reference even though they clearly use the term appeal in my letter.
    "If this charge has been paid and you choose to provide further evidence relating to your appeal, please forward this to us for consideration"
  • I sent my initial letter before reading the whole newbie thread, I've read the thread tonight but I couldn't see where it actually said why not to use the term "I"

    It's not an issue - a forum assisted POPLA appeal will still help you get this cancelled but appealing as the registered keeper would have given you some extra appeal points at the POPLA stage .

    Dear Parking Eye

    In reference to you letter dated xxxxx, there is nothing to add to the appeal, and as such try to abide by the instructions sent to you from the dvla. I know you have difficulty on following the most simple of things, so it's been added to this letter below:

    Now send the popla verification code or cancel it's up to you. But you have 14 days to do either.

  • Ah right, I've just been through and read the thread again a bit more slowly, I'm terrible for skim reading! I may not have used the exact words I was driving but just made reference to where people look when their driving. I've asked hubby to email me original letter. Although thinking about it I'm sure I said where "I parked" oh well hopefully it won't go against me! This forum is great btw, it's brilliant people will help out!
