Too late to appeal?!

I received a private parking charge mid-December last year:mad:, in a Napier run car park in Billingshurst. I pondered appealing and looked up on the net that it was a good idea to ignore these tickets as they are not enforceable - so I did. I have since seen on MSE the big words of warning on this very forum's sticky saying "do not ignore!!"... Whoops.

Unfortunately I didn't see this advise in good time and received a "Final Notice Before Legal Action" dated 3/4/14. I have today returned from holiday to this letter and I am thinking it is possibly best just to pay up the charge, which now stands at £140, and put the whole episode down to one of life's hard learnt lessons.

Before I do though, I would value some feedback... I have read through many of the posts on this forum, but given it is so late in the day, does anyone think there is anything I could do to avoid paying some or all of this charge, or is it best now just to pay up?

    you should still send in an appeal, to the PPC , although they will now say you are out of time and refuse you a popla code

    but it still needs doing so that even if it gets to court you can be seen to have tried to settle this

    This is Napier - they sue people. They also read this forum.

    Ignoring Napier was fairly silly even back before POFA 2012 as they sued people then as well. You should search the forum for 'Napier' as a keyword and you should formally respond to this letter. It's a Letter before Claim so read the 'LBCCC Fightback' thread which is of course up there in the forum stickies. You must respond, they will reply, then you will probably end up with small claim papers to defend (can be done and doesn't mean the costs rack up by much at all).

    I wouldn't just pay them as they are beatable in court. Read a lot about this car park though as they also own some of them and this one's been mentioned before. If they own it or De Savary does, then your case is harder to argue in court. Not impossible though as you could still say 'where is the loss'?
