Okay was this outside a coop by any chance? Because you will get a claim from on this, they are doing it because they know the coop will pay them not to take you to the small claims. You could head that off now by complaining to the coop.

  • Yes it was a coop car park in June 2011. Do you advise writing to them or just ignoring letter. The cheek of them!

Don't write to CEL as they will just ignore you, but write to the coop on this, tell them that this company is likely to issue a claim against you as you have researched on the internet and this is always the first step of doing this.

Insist that they intercede now to prevent this going further, tell them that you are loyal customer of theirs and were shopping on this day. Inform them that Civil Enforcement are their agents and as they are the principle they have the power to stop this at an early stage.

plenty of other people on here have had these court letters , so check it carefully to see if they obtained a judgement or not , if its a court letter

if its court papers that are the first stage , like the others, then you will have to acknowledge and deal with it , also contacting the co-op as per the info on here and on parking pranksters blog too (plenty of info out there on this)

there has always been this possibility when you first ignored them, as they have up to 6 years to make a small claim against you using the small claims service

if its a debt letter, then contact the co-op

This is not a claim yet, this is their stupid assignment letter where they say 87.5% of the debt has been passed on to fake debt collectors and they retain 12.5% of it. The next stage is a small claim though, without a letter before claim even.

so in this case they assign the debt, then they go to small claims , whereas some of the others have ignored the debt collectors, then get a small claims court papers out of the blue "

they must really need the money to pay that barrister they used when they lost !

I have just seen this posted by Gan on pepipoo, I'm sure he won't mind if I nick it lol
It's very much in the right category

Thanks to a piece of complete stupidity by the Co-op, CEL have been encouraged to follow up these letters with court claims in the knowledge that the Co-op will pay them if you complain

I would go on the offensive with CEL

Send a copy of the letter to the Co-op and ask them to confirm if CEL do in fact owe the £16-25

You can then send a letter to CEL

    Dear Sir

    Ref ****

I note your letter dated **** stating that you have no further interest in the alleged debt for £130 that, in any case, I completely deny

You will, no doubt, be pleased to learn that I have contacted the Co-op who confirm that you do not in fact owe them £16-25

I understand that your company has recently issued a large number of unfounded court claims shortly after sending the "debt assigned" letter stating that you no longer have any interest. In order to prevent such a situation, I have attached a copy of the said letter on which I have noted this point

If you believe that my understanding of your letter is not correct, I require a clear explanation within seven days
I will otherwise regard the matter as closed

    Yours faithfully

Make appropriate comments on their letter
    Staple them together
Keep copies and get a receipt from the Post office when you send the reply

  • Took advice and sent email to coop. Have asked for details from me so they can sort it for me. I feel they need to get rid of this company.
