Claiming Out Of pocket expense / calculating compensation

hi all,

I was watching a consumer tv show the other day and they gave the individual a compensation payout for inconvience caused etc, as well as the value of the defective service.

i'm wondering how do they calculate this? and also what aspects of out of pocket expenses are you able to claim for and how could you show this to anyone that has wronged you.

because i am thinking that i should have claimed for calling an expensive phone number when i had a complaint a while ago (i know its too late now its all been resolved), but if it were to happen again, what else could i reasonably include?

    Cost of extra days off work, phone calls, petrol for extra trips to return faulty goods, anything documentable really.

    Anything above things that can be proven is goodwill really, as obviously inconvenience does not have a price tariff.

    You'll likely find (if no actual loss was suffered) that the "compensation" is nothing more than a goodwill gesture.

    But generally speaking, if the other party is in breach of contract, they are liable for any losses reasonably incurred as a direct result of the breach. That doesnt mean they're liable for all losses however as you have a statutory duty to try and mitigate your losses any way you reasonably can.

    Provable losses, you cant claim for inconvenience.
