How long is statute of limitation on a credit card please?

Hello guys, I wonder if someone could answer a question.

I wondered if there was a time period where a credit card would be written off?

Long story but briefly my friends partner maxed out a credit card before he met her. They have been togethere three years and have two kids. They cannot buy a house as he moved and didnt tell the cc company where he moved to and has not paid them back. I totally do not agree with this action, I feel he should pay back what he owes, but Im just looking out for my friend and if there was an other option I would advise them to do it. He works full time and with two small (unplanned...) babies they just cannot afford to pay this back just yet. When the girls are bigger my friend can go back to work and they can move on, but at the moment they are in a small council house and cannot get out of the rut.

I hope someone can give some advice. I know they need to pay this back, and its not right that he should get away with it, but they are in the situation they are in, things have been done, its a case of trying to help them out of it.

  • It will become statute barred after 6 years from the date of the last payment/contact with the card issuer.

    He may end up with a CCJ which will stay on his file forever untill it is paid. Then it will drop off after 6 years.

    I recommend he takes his head out of the sand and contact the bank. I would have thought that the debt would have been sold on already to a collections agency. He maybe will be able to come to an agreement with them to pay it back at a reduced rate.

    Loads of info on the debt free board. Have a look on there or even better suggest that he looks on there.

    Thanks for your replies, I appreciate it. I know you are right he needs to not avoid it and he should pay back what he owes, but unfortunately the situation is what it is and he is very regretful now he has responsibilities. I am just trying to find a solution for them as this now affects my friend and her children (my godchildren). I will have a look on the boards cheers (as they dont have a computer).

    Just to clarify do you mean he will def get a ccj regardless. But six years from the date of the last payment it will be written off? In a way that would be good news for them, but from a personal point of view I have always paid back my debts and it doesnt seem fair that people can blow money on credit cards and just not pay it back. But then again I have a nice house and a good job and, apart form a mortgage, no debt. He lives in a council house that is too small and struggles to make ends meet and works six days a week 12 hour shifts. I know which I would rather...

    It is not 6 years from the last payment. If the lender left it for 5 years and 11 months, and then caught up with him, the 6 year clock is reset.

    If they have no money, why are they looking at buying a house?
