Tax credits nightmare

                    Hi all am seperated from my husband over 2 yrs I received tax credits bit last yr they stopped them because my husbands post still came to our home as he had no fixed abode. I have been fighting with them from jan 13 till get them reinstated have proved that he does not live with me as I had his post changed and of the electrol list I just can't prove from jan 12 till jan13 he wasn't livin with me as all our bills were joint names I have sent them ure bank statements showin him payin my matience only nothin towards mortgage I paid this all. I am now in process of havin my home repossessed and eventually bankrupt as I no longer could pay my bills as I had reduce my working hours as could not afford full time childcare. I am waitin on my tribunal which keeps gettin cancelled by them at last min dies anyone know if I will be backdated from jan last year maybe then I could save my house they are also looking me pay back 6000 pounds for first year we spilt up any help would be most grateful.

            In addition to help on here You need to ask questions on bankruptcy board as the OR could possibly get the money, so you lose your home anyway.Tomorrow is the most important thing in life0

            No one can say, it will depend on the evidence you can put to the Tribunal.
If HMRC are cancelling at the last minute with no good reason, the Tribunal can make directions that either exclude them from the hearing or order them to sort out whatever the problem is.
I would suggest you get some advice from a welfare rights person who knows tax credits, as you will need to know the legal arguments to put.
If you were married, you will need to show that you were 'separated in circumstances likely to be become permanent'. Also someone needs to check that the Revenue used the correct powers and that their decisions were taken under the correct sections etc...

            I can't prove he wasn't living with me 4 first year as all post was joint names once tax credits was stopped last jan I changed everythin and proved I was single can't understand why my name claim was not reinstated while waitin sort out old one it's a disgrace .0
