Claiming on Visa debit card

Hey people

I recently bought a projector from a company online by the name of Tiptop Electronics. It was faulty and had to be returned.

To cut a long story short although they have conceded that they are obliged to supply with a new working unit or refund me, neither has happened. Their excuse is that their accounts have been frozen, hence forth they are incapable of opening the till and paying me my money back.

I paid for the projector by bank transfer on a visa debit card. Although I was aware that I didn't have the same level of cover that I would if I paid by credit card (they weren't accepting this form of payment at the time) i didn't to expect that I wouldn't have any cover at all.

I contacted Nationwide to make. A claim but was told that because I made the transaction using the sort code instead of the long digit code across the middle of the card, I have no cover whatsoever.

Im here to ask wether this is legal? I assume it is.

Hopefully by posting this I can help to raise awareness to people, when paying by debit, always use the long number across middle and not make the same mistake that I did!

A bank transfer is akin to handing over cash, it is not actually a payment made with your card - so unfortunately the protection given by cards doesnt extend to transfers.

Is the company a UK company? Are they in liquidation?

They are a UK based company who are still trading under the name Tiptop Electronics.

They have informed me that they don't have the money to pay me back, I guess small claims court is now my only option.

Bank transfer with a debit card isn't possible.

It's a bank transfer if you give them the sort, name and account number.

It's a debit card transfer if you pay using the long number and the ccv on the reverse.

They know this most likely, which means they do have you hook line and sinker. Time for a mcol me thinks...

The bad news is also that it's actually an Australia sold domain through https://www.crazydomains.co.uk

It's all very confusing, reading all the conflicting opinions .....the Australian connection, does thar mean I have no possibility of sorting this mess out in a small claims court?

Re "they have me hook line and sinker" ....so does the fact I paid them by debit card via the sort code, name and account number strip away any form of legal claim I have against this company....how does that work?

You did not pay by debit card, you paid by bank transfer. You still have the right to go to small claims, but before doing so try to find out if they have the funds to pay you - a judgment does not automatically mean you will be paid.

Ok, the director Mr Ben Broome has assured me on numerous occasions that I will be reimbursed but it's dragging on and I want a resolution.

He claims that the company is still doing healthy business although their accounts have been frozen rendering them unable to pay.

    He's lying.

I suspect as much he constantly fobs me off with lame excuses and I've had enough so next step is the small claims court.

If I am awarded a judgement against him and he refuses to pay, where does that leave me?
