Rejected Appeal, is it worth going to Popla

I received a notice back in Feb for failing to display a valid permit. The car was parked at a college where you have to have a permit and display a parking ticket too. The day in question was very windy and the permit got blown down onto the driver's footwell and the parking ticket was blown so although it remained on the windscreen it was face down. The contractual breach charge was £80 or £40 if paid within 14 days. I appealed to Ethical Parking but having since been guided to this forum realise I have prob done everything wrong and my appeal has been rejected. I know I can't appeal to Popla with mitigating circumstances so not sure how to go down that route. However, after doing some research on line and reading the BPA's code of conduct wondered if I stood a chance of appealing as under section 22, 22.8 I should have had a response within 35 days of them receiving the appeal (I appealed on line the same day I received their ticket). My response has taken over 50 days. Any help much appreciated as they have given me until 23rd April to pay £40, after that date it rises up to £80.

    Did they send you a POPLA code with the appeal rejection letter? If so then check it at http://www.parkingcowboys.co.uk/popla-code-checker/ and remember the clock is ticking.
  • You will easily win at POPLA - as long as you get the key points in - no contract / no GPEOL / inadequate signage. It will win on the GPEOL though.
