Where do i go from here

Hi to who ever reads this and takes notice of it and thank you for your help and support against these scummy f*****s.

I will bore you with a story you wont want to hear right now but to help me set the picture for you to understand then here i go. its not a sob story but.

Basically had a crap time at home and had to leave, (it was my fault) needed somewhere to stay in my work van so i stopped at the local services, Welcome break fleet south on the M3 and i stayed there from 09/02/2014 23.51.53 to 10/02/2014 09.34.16.
I have photo evidence of me arriving and leaving the site at those times.

A total of 9 hours 42 mins.
In the lorry car park in the darkest, quietest corner i could find, out of the way. didn't interfere with anything or anyone, the rules and regs are not lit up on entry to the carpark.

After listening to advice from friends, relatives and people who have been here and people who know the law(ish) i decided to ignore the letters from them.

Now ive just been sent a 'letter before county court' letter after ignoring them,

What shall i do with this and how can i go about telling them to sod off.
any links to look at and read, ive read a few of them and it looks like i have to start a appeal process but with who and where do i find it

All of your help would be greatly appreciated with this, many thanks

Have you read through the NEWBIES sticky at the top of the first page of this forum? It will give you a good starting point to get your head around this stuff and then we can help you progress from there.

Who is the private parking company (PPC)?

Have you used the excellent site search engine with their and Welcome Break's names in the search criterion?

Try it, you will find many similar cases that have been dealt with previously.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Sorry to hear of your troubles, and the demands.

However this sort of rubbish is easy to beat - but not by ignoring or telling them to sod off.

Read the newbie info and come back if you need clarification on anything.

Your case is just the same as me in my camper stopping for a few hours sleep on a lengthy journey.

Follow the advice in the correct order and you will not pay anything.

Is this Parking Eye? You must respond to a LBCCC and that's what the parking forum sticky threads are up the top for. Are the letters arriving in your personal name or addressed to 'your work, company name'? If it's the latter then write in another employee's name on work headed paper (assuming it's your company) naming yourself as the driver with your home address. Naming the driver when not the same name as the 'keeper' rewinds the clock back to a PCN you can then appeal and win at POPLA. But then again the sticky threads cover this as well.

'Private parking ticket, old or new? NEWBIES read this first' thread and LBCCC Fightback thread are at the top of this forum in the 'sticky' (permanent advice) threads.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Right, sorry folks been away for a while.

Really appreciate all your help you have given me. Like a forum virgin you dont read first you just ask questions.Whos the plank!!

Ive now had a letter through from the DRP demanding payment of £150. Parking eye have passed it over to them to chase.

After reading the sticky thread and the awesome template that was posted by Coupon-Mad, i have now informed parking eye of my appeal and also the DRP.

Now i will wait for them both to get back to me i guess. When they do ill be straight back on here reading first then asking questions.

    Thanks again folks.

So the other thing to do is to read the Small Claims section of the NEWBIES thread - you'll need the links to win this as you missed a trick (POPLA) and PE do sue people. Also stick around to read about the impending PE test case decision from HHJ Moloney soon, as it will lead to a lot more discussion whatever the outcome and may well affect our advice going forward.

    Do PE use DRP?

Sounds like OP has NOT had a LBCC if DRP have sent another chaser letter.
