Stolen Cheque

Hello
Can anyone help. I have processed a claim through fast track reclaim for PPI taken out with Capital one which was concluded and a cheque put in the post, the cheque never reached me and since christmas I have been backwards and fowards between the two parties who have now concluded the cheque was cashed at some pawn brokers in Bristol. Capital one are stating that they will not be re-issuing as it is not there responsibility there view is they have issues a cheque which has been cashed. They have also suggested that I raise with the police.
As we are now 4 or five months past the incident I would have assumed they had done this long since and was surprised to find they did not, in any event where do liabilities lie in this matter and what is my next action, any help would be great.
The cheque was for about £800
