Newbie - mis sold car Arnold Clark. Help :-(

Hi, i'm very new to this, so not entirely sure of the way it all works but i was hoping for some advice, I hope i am posting on the correct part of the forum.
We were sold a hyundai santa fe in 2012, its a 59 plate so 4 years old with 39k on the clock. The dual mass fly wheel needs replaced but we have found out that our car is infact an irish import with no warranty. We were lead to believe it came with a 5 year hyundai warranty and at no point were made aware that the car was imported. I phoned arnold clark and they confirmed it is imported and that I should have recieved paperwork detailing this (i did not)
I have spoken with my finance company who are investigating this as my car now needs £1.5k of work done and is worth MUCH less than if it had been a british build.
Is there likely to be any resolution to this? The finance company aren't giving much away. Does arnold clark have a duty to act on this if the car has been missold?

  • The dual mass flywheel will be classed as a wear and tear, as regards the warranty i purchased a car imported from europe and that came with a full warranty .

    The Hyundai should have the warranty even if bought form Ireland so keep onto them.
  • Irish hyundais purchased registered before 2010 only come with 36 months warranty I have found out. A dealership have offered me £2000 to part exchange it?!

    In it's broken state with DMF needing replacement?

    Irish import will have quite limited impact on resale price although traders will tell you otherwise to get it cheap.

    Dmf failure is wear and tear so wouldn't be covered by a warranty anyway

    Also a dmf is usually around £500 plus a couple of hundred to fit by an Indy not a main dealer.

  • From what I can deduce from other forums etc the dual mass fly wheel is a common issue with the make/model/year of my car and has been honoured under warranty. For the clutch/fly wheel replacement i've been quoted £1500 (cheapest) £1945 (dearest) i've been advised to replace both.
    At the end of the day, if i have to pay it, i have to pay it. The real problem is it being an import and not being aware? Its not on my v5, but i did contact the previous owner who confirms it is an import, arnold clark brought them over cheap.
    The dealership that offered me the trade in - taking into account flywheel- say that they had to request a CAP valuation from R.O.I and came back with £2k!! Are they at it?

    Yes it's a wearable item, but any reasonable person expects a flywheel to last much longer than what it has. Something is clearly wrong with it to have deteriorated after just 40k.

    Get on at the dealer to make a contribution of about 50%.

    And don't have them quoting stupid prices.

    LUK flywheels and 3 piece clutch kits are around £500 + fitting. 3-4 hours.

    I think the only angle of hope here is proving that hyundai would pay for it under warranty, and then proving that they werent told it was an import in the first place, and then asking the dealer to pay for / make a contribution under those circumstances. That might be a tough nut to crack.

    Also, whilst i take your point about DMF lasting longer than that, the problem here is - and what tends to cause the failure - is lots of small runs as the most wear is caused to a DMF by a diesel engine when its starting up.
  • Good luck with Arnold Clark giving you anything with this one. They are known within the industry as ARNOLD SHARK.

    My son works for them and the only time they give in is when you get help from a good consumer lawyer.

    They usually only give in when you get a date to go to court. They hate bad publicity. When they do settle (usually out of court) they get you to sign a decleration that you wont publicaly disclose the terms of your settlement
    There is no point going to the press either as they advertise with all the national press and local press. So any newspaper who runs a story such as yours gets their advertisments withdrawn.
