Ex landlord harassing for money that isn't owed.

    In your eyes perhaps but I think we're all trying to help your friend not acquire a CCJ for rent rightfully owed. There not being any documentary evidence of her and the landlord agreeing to any early surrender is putting your friend at serious risk.

    Courts don't give a monkey's about verbal agreements, they will want to see hard evidence.

    Reference was given to the new landlord, that should count for something, right?

    You say your friend lived in the property for some years, and then go on to mention another party having lived there as well.



    Three questions:

    When did your friend last sign a tenancy agreement? By the landlord claiming rent until this June suggests that she signed a renewal at some point. Is this correct?

    This is correct and I've asked her to find the agreement and show me it.

    The other person: was this a joint-tenancy?

    No.

    Has the property been re-let since the landlord failed to secure a buyer?

    The property has been removed off the marked firstly because it was going through a sale. It did not go through in the end. Iv'e found website where it states that property has been removed off market temporarily i.e it might be let.

    I think your friend should pop round there and see if anyone else has rented it and if so, from what date.

    the fact that the LL gave the tenant a reference could also help demonstrate she was leaving the tenancy by agreement. But to be honest, both parties are a bit suspect. Why was she prepared to accept this kind of treatment without doing anything about it?

    Because she was scared of him, he bullied and harassed her. She didn't know her rights and thought it's LL's property and he can do as he likes. She went to CAB for advice and that's exactly what they told her.

    He threatened her on numerous occasions over the phone saying "he isn't a LL to be messed with" etc.

    Thank god she managed to get away and secure a new home with a reasonable landlord. I dread to think if she wasn't lucky and did not move out when she did. No one wants to be chucked out on the streets during New Years because your home is being rented out to someone else.

    That's a good idea. I will go by the property tomorrow and see if there are any signs up.

    Signs up? Just knock on the door and ask! If it has been re-let ask them how long they have been there. If they're nice they might allow a photocopy of their tenancy agreement to be made.

    lol.., you think? With a LL as described?

    I wouldn't and mine is bad., but not as bad as described.
